HomeMy WebLinkAboutORD 607 (1974) 1 = ORDINANCE NO 607 2 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, ADDING CHAPTER 6A TO THE TUSTIN CITY CODE RE- 5 LATING TO REQUIRED CONSUMER PROTECTION IN CONNECTION WITH RESIDENTIAL SALES. 4 5 The City Council of the City of Tustin does hereby 6 ordain as follows: 7 SECTION I: Chapter 6A is added to the Tustin City 8 Code to read: 9 CHAPTER 6A 10 CONSUMER PROTECTION IN RESIDENTIAL SALES 11 Article I. First Sales In Residential Subdivisions. 12 Section 6A-1. Purpose. This Chapter is enacted in 13 order to insure that purchasers of residential properties within 14 the'~City of Tustin upon first sale will be fully advised of the 15 exact nature of the purchase, including information relating to 16 the zoning of surrounding properties and the City's Master Plan 17 of Land Use as well as prevention of misleading information about 18 the quality of construction. 19 Section 6A-2. Model Homes. All model ho'mes constructec2 20 for sales purposes in a residential subdivision shall be buiiz 21 in exact accordance with the building construction plans sub- 22 mitted and approved for all structures to be built in the sub- ~ division. No change, alteration or increase in the quality or '24 quantity of construction materials or decorator finishes, shown 2§ on the approved building .plans, shall be permitted in a 'mode]. 26 home, unless every such change, alteration or increase is plainly 27 marked by signs wi'thin view of .prospective purchasers and located ~8 at the place of the change, containing letters and numbers of not 1_ less than 2" in height'setting forth the exact d~fferences in \ 2 specifications. Those items installed ih the model by the de- 5 veloper as decorator items which are not for sale and those 4 items installed as optional accessory furnishings or materials 5 shall likewise be marked with signs of not less than 2" letters, 6 indicating such to prospective purchasers. 7 Section 6A-3. Furnishing of Planning and Zoning. 8 Information. Every person, firm or corporation selling, or offer- 9 ing for sale, 'residential property within an appreved subdivision 10 tract in the City of Tustin shall attach, affix or otherwise !1 incorporate into all printed matter relating to sales information 12 about said residential properties, copies of the latest revised 15 edition of the City of Tustin Zoning Map, the latest revised 14 edition of the Map of the Land Use Element of the Tustin Area. 15 General Plan, and the latest revised edition of the School 16 District Boundaries Map showing all school districts within the 17 City of Tustin slnowin~ t_~e location of schools and assignments o~ 18 school population served, as furnished by the Tustin Unifie.d 19 School District- Said editions shall be as prepared or approved ~0 by the City of Tustin, bearing the date of approval and the signa- 21 ture of the Secretary of the Planning Commission. A reasonable 22 fee for such maps may be charged. ~ .Article iI- Voluntar~r Structural Inspection- '24 Section 6A-4.
