AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA,
2 AMENDING THE TUSTIN CITY CODE RELATIVE TO WAITERS,
5 WAITRESSES., ENTERTAINERS AND PERFORMERS.
The City Council of the City of Tustin~ California,
4 does ordain as follows:
5 The following sections are hereby added to Chapter 8 of
the Tustin City Cod'e, to read as hereinafter set forth:

Section 8-28. Prohibitions: Definitions: Waiters,
7 Waitresses, Entertainers.
8 Every person is guilty of a misdemeanor who, while acting
as a waiter, waitress or entertainer in an establishment which
9 serves food, beverage, or food and beverages, including, but
not limited to, alcoholic beverages, for consumption on-the
!0 premises of such establishment:
11 (a) Exposes his or her genitals, pubic hair, buttocks, natal
cleft, perineum, anal region or pubic hair region; or

(b) Exposes any device, costume or covering which gives the
15 appearance of or simulates the genitals, Pubic hair,
buttocks, natal cleft, perineum, anal region or pubic
14 hair region; or
15 (c) Exposes any portion of the female breast at or below
the areola thereof.

Section 8-29. Counseiinq or assisting'.
Every person is guilty of a misdemeanor who causes,
18 permits, procures, counsels or assists any person to expose
or simulate exposure as prohibited in Section 8-28.

Section 8-30. Employment o.r. payment not necessary for
20 offense.
21 A person shall be deemed to be a waiter, waitress, or
entertainer if such person acts in that capacity without regard
22 to whether or not such person is paid any compensation by the
management of the establishment in which the activity is
25 performed.
24 Section 8-31 o Prohibitions: Definitions: Public
per formance.

Every person is guilty of a misdemeanor, who, while
'26 participating in any live act, demonstration, or exhibition
in any public place, place open to the public, or place open
~7 to the public view:
28 (a) Exposes his or her genitals, pubic hair, buttocks, natal
cleft, per~ineum, anal region, or pubic hair region; or
(b) Exposes any device, costume or covering which gives the
50 appearance of or simulates the genitals, pubic hair,
buttocks, natal cleft, perineum, anal region or pubic
· ~1 hair region; or
52 (~) Exposes any portion of the "female breast at or below the

Section 8-32. Counselinq or assisting.
Every person is quilty of a misdemeanor who causes, permits,
procures, counsels or assists any person to expose or simulate
exposure as prohibited in Section 8-31.
Section 8-33. Exemption of theatrical establishments.
The provision of Sections 8-28 through Sections 8-32
of this chapter shall not apply to a theatre, concert ha. Ll.~
or similar establishment which is primarily devoted to
theatr ica 1 performances.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, held on the 20th day of August, 1973.
