HomeMy WebLinkAboutORD 589 (1973) ORDINANCE NO. 589 AN ORDINANCE OF THE CITY OF TUSTIN CALIFORNIA, AMENDING THE TUSTIN CITY CODE RELATIVE TO PARKWAY TREES The City o'f Tustin, California, does ordain as follows: 1. Section 18-28 of the Tustin City Code is hereby amended to read as follows: Section 18-28: Trees and Landscapin.g (a) Trees of the types set forth in the City's List of Aporoved Trees shall be provided for by the subdivider in accordance with the Master Tree Plan and City planting requirements. (b) Prior to approval by the City Council of a final map, the subdivider shall pay to the City t~e cost of purchasing and planting said trees, together with the cost of maintenance of said trees for a period of one year. A fee schedule shall be specified by resolution of the City Council for the basic size of the various species of trees. A greater price may be negotiated for the planting of larger or more expensive species, with the concurrence of the subdivider and the Maintenance Superintendent. (c) City shall be responsible for the installa- tion and maintenance of parkway trees in the manner and type specified herein, with the planting to be approxi- mately at the time structures are occupied but not later than the date of acceptance of the i'mprovements of the tract. 2. Chapter 23 of the Tustin City Code is hereby amended to read as follows: Section 23-1: Purpose of this Chapter. The City intends to maintain and exercise full power, authority and jurisdiction over all trees, plants or shrubs in or growing upon or over any public parkway street, highway, alley, right-of-way, City-owned pro- perty in the City. Section 23-2: DamacLq It shall be unlawful for any person to fasten any animal~ guy-rope, guy-line, or any other contrivance to any tree or shrub or to any stake, guard or other plant-protective structure located in ally public parkway street, highway, alley, right-of-way or other City--oWned property, from which danger or injury may result to any tree, plant or shrub. Section 23-3: Des truction It 'shall be uniaw. ful for any person to cut do~n~ g_~r~J]e? remo~,~: ~n'j~r~ defa~ ~r destroy any tree or '1 shrub or any ornament or improvement on any public parkway/street, highway, alley, sidewalk or right of 2 way within the City, without first obtaining written consent therefor from the Maintenance Superintendent 3 of the City of Tustin. 4 Section 23-4: Maintenance 5 Except as may otherwise be provided herein, it shall b'e the duty and responsibility of every person 6 to water and otherwise maintain in proper and sightly manner, all trees and shrubbery located in the public ~ parkway, street, highway, alley, sidewalks and right-of- way located immediately in front of or along side of, 8 and contiguous to property owned by said persons. 9 Section 23-5: Permit to Trim 10 lqo person shall cut, break or trim any tree or plant in any parkway, street, sidewalk, highway, alley 11 or right-of-way without first obtaining from the Maintenance Superintendent a %~ritten permit therefor. 12 Section 23-6: Trimminq of Limbs When the Maintenance Superintendent determines I.~ that any limbs or branches or other growth on any trees or shrubbery growing in, cn or over any land owned by 15 the City or located in any public parkway, street, highway, alley or right-of-way should be trimmed, the 16 Maintenance Superintendent may cause such trimming to be done, or by direction of the City Council may cause 1~ directions to be given to the property owner in front of whose proper'ty said trees or shrubbery are located, 18 to perform such trimming. ]9 Section 23-7: Requirements of Plantinq ~0 Whenever any person shall apply for a building permit for the construction, reconstruction, remodeling Z1 or addition of any structure, with a cost of construction, reconstruction, remodeling or addition exceeding fifty 2~ percent (50©) of the then assessed value of the then existing improvements upon the property, said plans of ~5 improvement shall show and provide for planting of trees in accordance with the Master Tree Plan of the ~4 City. Z5 Section 23-8: Master Tree Plan ~ Trees shall hereafter be planted in the City of Tustin in public parkways, 'streets, highways, alleys, ~7 sidewalks and rights-of-way, in accordance with the Master Tree Plan adopted by resolution of the.
