HomeMy WebLinkAboutORD 586 (1973) 1 ORDINANCE NO. 586 .-- 2 AN ORDINANCE OF THE CITY OF TUSTIN. CALIFORNIA· AMENDING THE TUSTIN CITY ~ CODE RELATIVE TO PARKWAY TREES 4 The City of .Tustin. California· does ordain as follows: 5 1. Section 18-28 of the Tustin City Code is hereby amended 6 to read as follows: Section 18-28: Trees and Landscaping 8 (a) Trees of the types set forth in the City's List of Approved Trees shall be provided for by the subdivider 9 in accordance with the Master Tree Plan and City planting requ iremen t s. 10 (b) ~Prior to approval by the City Council of a final 11 map. the subdivider shall pay to the City the cost of pur- chasing and planting said trees· together with the cost of !~ maintenance of said trees for a period of one year. A fee schedule shall be determined by the City and adopted by 15 resolution of the City Council for the customary size and species of trees planted, although a greater price may be 14 negotiated for the planting of larger or more expensive " species. (c) City shall be responsible for the installation 16 and maintenance of parkway trees in the manner and type 1,~ specified herein, with the planting to be approximately at the time Structures are occupied. but not later than the date of acceptance of the improvements of the tract. 18 ~ 19 2. Chapter 23 of the Tustin City Code is hereby amended to ~0 read as follows: ~1 Section 23-1: Purpose of this Chapter. ., , ZZ This chapter is intended to give full power, auth6rity and jurisdiction to the City of Tustin over all trees· Z5 plants or shrubs planted in or growing upon or over any of the public streets, highways, or rights-of way of or in the ~4 City. 25 Section 23- 2: Damage ~6 It shall be unlawful for any person to fasten any animal· guy-rope, guy-line, or any othe.r contrivance to any ~ 27 tree or shrub or to any stake guard or other protective · · , structure ~located in the public streets· highways or a].leys 28 or upon City-owned property, or in any manner· from which danger or injury may result to such trees, plants or shrubs 29 Section 23-3: Destruction 50 It shall be unlawful for any person to cut down· 51 girdle: ~emove, injure~ deface or de.qtr~y ~ ~din~ ~r growing tree or shrub or any ornament or improvement on any .~ public street, highway, alley or sidewalk within the City, ,~o~&~o~oo~ without first obtaining written consent therefor from the c~oc~-c,-r,z~ Maintenance Superin[~.ndent of ti~e City of Tustin · ~[ANTA AN/,., CA. Section 23-4: Maintenance ~ Except as othez~ise provided herein, it shall be the duty and 'responsibility of every person to water and other- ~ wise maintain in proper and sightly manner, any and all trees and shrubbery located in the dedicated right-of-waY, 4 street, highway, alley or sidewalks located in front of pro- perty owned by said persons. Section 23-5: Permit to Trim No person shall cut, break or trim any tree or plant in 7 any dedicated right-of-way, street, highway, alley or side- walk, without first obtaining from the Maintenance Super- 8 intendent a written permit therefor. 9 Section 23-6: Trimminq of Limbs 10 When the Maintenance Superintendent determines that any limbs or branches or other growth on any trees or shrubbery 11 growing on or over any land owned by the City or located in dedicated rights-of-way, public streets, highways, alleys 12 or sidewalks, should be trimmed, the Maintenance Superinten- dent may cause such trimming to be done, or by direction 15 of the City Council may cause directions to be given to the property owner in front of 'whose property said trees or 14 shrubbery are located, to perform such trirmning. 15 Section 23-7: Requirements of Plantinq. 16 Whenever any person shall apply for a building permit for the construction~ reconstruction, remodeling or addition 17 of any structure, with a cost of construction, reconstruc- tion, remodeling or addition exceeding fifty percent (50%) 18 of the then assessed value of the then existion improvements upon the property, said plans of j. mprovement shall show and ~9 provide for planting of trees in accordance with the City's Master Tree Plan to be planted in accordance with stnadard ~0 specifications established by the City. Section 23-8: Master Tree Plan Trees shall hereafter be planted in the City of Tustin in dedicated rights-of-way, public streets, highways, alleys, sidewalks or parkways, in accordance with a Master Tree Plan adopted or modified by resolution of the City' Council. ~5 PASSED AND ADOPTED at a regular meeting of the City Council ~6 of the City of Tustin, California, held on the 18th day of June, 1973. ~8 50 ' 51 ATTEST.: STATE OF CALIFORNIA) COUNTY OF ORANGE )ss CITY OF TUSTIN ) RUTH C.
