HomeMy WebLinkAboutORD 580 (1973) 1 ORDINANCE NO. 580 ~ AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, PREZONING PROPERTY OF ROY DALY ON APPLICATION PZ 73-1 3 FILED BY THE PLANING COMISSION ON ITS OWN MOTION 4 The City of Tustin, California, does hereby ordain as 5 follows: 6 1. The City Council finds and determines: ~ a) That a proper application (No. PZ-73-1) was duly filed on behalf of Roy Daly by the Planning Com- B mission on its own motion for a zone Change from County of Orange R-4 District to the City of 9 Tustin R-3 (1900) of the property described in Exhibit "A" attached hereto and incorporated 10 herein by this reference as though set forth herein in full. 11 b) That a public hearing. was duly called, noticed 12 and held on said application by the Planning Com- mission of the City of Tustin, and thereupon said. 15 rezoning was recommended. lz! c) That a zone change should be granted for the fo.' !owin~ reasons: 15 =" 1) Subject parcel has been developed at a dens~y 16 in excess of the proposed development. t~! 2) The remaining portion of the property has been retained as an abandoned and non-productive 18 citrus grove that is the cause of public con- cern and potential nuisance. 19 3) Subject parcel is proposed for annexation to 20 the City of Tustin, concurrently with the adjoining parcel.  ~ ,d) Development of subject property' should-be in ~ accordance with the policies adopted by the City Council, Uniform Building .Codes as administered by 25 the Building Official, Fire Code as a~ninistered by the Fire Chief, and street improvement require- 24 ments as administered by the City Engineer. 25 ~ ~Final development plans should require the review and approval .of t'he Development Preview Commission f) The proposed zone change and development are no{ ~7 in conflict with the General Plan or elements thereof. 28 g) ~he property o~.rner has consented to a reduction in Z9 density ~rom the proposed R-3 (1900)' to which would Outhorize the construction of an addi- 30 tional 31 units. ~ 2.
