HomeMy WebLinkAboutORD 565 (1973) ORDINANCE NO. 565 AN ORDINANCE OF THE CITY OF TUSTIN PREZONING PROPERTY OF BEST YEARS, INC. ON APPLICATION NO. P.Z. 72-138 4 The City of Tustln does hereby ordain as follows: 5 Upon recommendation of the Planning Commission made 6 public hearing duly called, noticed and held, and after public 7 heaEing duly called, noticed and held by the City Council, the pro- 8 perry described in Exhibit "A" attached hereto is hereby prezoned 9 from the Orange County C-2 District to the Tustin PC (Planned 10 Community) District, effective upon annexation of the subject pro- 11 perty to the City, subject to the following conditions: 12 1, Annexation to the City of Tustin; 15 2. Submission of a specific plan of development, sub- ject to final approval by the staff, Development 14 Preview Commission and Planning Commission. Said plan to be restricted to the following development 15 criteria: 16 'a) No residential structures t'o be located closer -- than 50 feet to adjacent residential property 17 lines; 18 b) Height of all structures not to exceed three stories; 19 c) Density of any multiple-family residential por- 20 . tion to be no greater than one dwelling unit per 1250 sq. ft. (34 dwelling units per gross acre); 21 designed and occupied as proposed as an adult 22 community; ~ d) Parking areas and traffic circulation patterns 23 to be approved by the City Engineer and Develop- ment Preview Commission; e) At the time of the first construction of any 25 improvements on the subject property, on-site improvements for the entire property shall be 26 constructed, including flood control channel , enclosure, total grading, installation of per- 27 imeter landscaping, planting of grass and in- stallation of sprinkling system on parcels B & 28 as hereinafter described~ or execution of an agreement to install said grass and sprinkling 29 system within one (I) year of the time building permits are issued for the residential develop- 30 .. ment,. together with a bond, each in form, content and amount satisfactory to the City Attorney. 31 3Z I . f) At the time of the first construction of any improvements on the subject property all off- Z site improvements for the entire property shall be constructed, including drainage facilities, 3 curbs, sidewalks, street trees, lighting and 4 perimeter landscaping. 5 g) Prior to commencement of any construction, a parcel map shall be filed and approved dividing 6 the property into three parcels as follows: 1) Parcel A, for the residential portion of the property; 8 2) Parcel B, to be a parcel not less than acres in size, contiguous to Parcel A and 9 .open to it for use, and to be perpetually re- tained as a common open space area, unless 10 and until the commercial portion of the property is constructed in substantial 11 compliance with the approved plans therefor 12 or with such plans as may hereafter be approved by the City of Tustin. 15 3) Parcel C, for the commercial portion of the 14 proper ty; 15 4) Parcel B may be developed for commercial purposes in conjunction with Parcel C, if developed in compliance with an approved 16 precise plan. 17 PASSED AND ADOPTED at a regular meeting of the City 18 Council, held on the 15th day of January, 1973. 19 Z0 23 24 ATTEST: CLERK 29 30 31 1/4/73 ORDINANCE NO. 565 EXHIBIT "A" Parcel fronting approximately 315 feet on the north side of Irvine Blvd., lying between the Southern Pacific Railroad right-of-way and the Oran~.e County Flood Control Channel.
