ORDINANCE NO. 552
AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA
3 AMENDING THE ZONING ORDINANCE, ORDINANCE NO. 157
AS AMENDED, AND THE SIGN ORDINANCE NO. 438, AS
4 AMENDED, CREATING THE OFFICE OF ZONING ADMINIS-
TRATOR AND DEFINING THE DUTIES OF THE OFFICE.
The City Council of the City of Tustin, California, does

ordain as follows:
Section 1: Created.

Pursuant to Section 65900 of the State Planning and
9
Zoning Law, there is hereby established the office of a Zoning
10 Administrator.

Section 2: Duties

The Zoning Administrator, subject to the provisions of
13
the Zoning Ordinance, Ordinance No. 157, as amended, and the
14
Sign Ordinance, Ordinance No. 438, as amended, shall have juris-
15
diction to hear and. decide in accordance with Council Policy:
16
a) Applications for variances from the terms of the
17 zoning regulations.
18 .b) Applications for Use and Conditional Use Permits
for those uses subject to a Use Permit within the
19 district regulations.
20 c) Matters relating to the conforming and nonconforming
use of properties and the structures thereon.
d) Applications for variances from the terms of the
22 Sign Regulations.
25 e) Applications for Use Permits as provided for any
of the uses for which such permits are required or
~4 permitted by the terms of the Sign Ordinance.
~5 f) Such other matters as the Council may direct to be
heard and findings made.

Section 3: Decision of the Zoning Administrator
The findings and decision of the Zoning Administrator

~hall be publishedby memorandum no later than seven (7) calendar
29
days from the date of hearing and 'distributed to the applicant,
30
City Council, Planning Commission, and interested persons. The
31
.... ~ng Administrator shall grant, conditionally grant, or deny,
the application for Variance, Use Permit, or finding of non-
1 conformity, based upon applicable criteria. Such action, unless
2 appealed, shall be final on the eighth day following publication-
5 of the decision.
4 Section 4: Review and Appea~.
5 a) The City Council, Planning Commission, any two
members of either body or any person with vested
6 right may file an appeal with the City Clerk on
any decision of the Zoning Administrator prior to
7 the time it becomes final.
8 b) A fee of $30.00 shall be paid for the filing of an
appeal by other than Council or Planning Commission
9 Members.
10 c) A public hearing shall be set, noticed and held
before the Planning Commission.

d) The Planning Commission may affirm, modify or re-
12 verse the findings and decision of the Zoning
Administrator.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California, held on the 16th day of October, 1972.

certify that the whole number of members of the City Council
of the City of Tustin is four; that the above and fore-
~going Ordinance No. 552 was duly and regularly introduced
and read at a regular meeting of the City Council held on
the 2nd day of October , 1972 , and was given
its second reading and duly passed and adopte~ at a regular
meeting held on'the 16th day of October 1972, by
