HomeMy WebLinkAboutORD 543 (1972) ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE ANNEXATION OF 2 CERTAIN UNINHABITED TERRITORY, DESIGNATED PROSPECT-IRVINE-NEWPORT ANNEXATION NO. 68 (REVISED) ~ , TO THE CITY OF TUSTIN, CALIFORNIA. 4 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TUSTIN 5 WHEREAS, pursuant to the provisions of the Government Code of the State of California, application was made to the 6 Local Agency Formation Commission tO annex. tc the City of Tustin all t~hat territory situated in the County of Orange, State of 7 California, hereby designated as Prospect-Irvine-Newport Annexatio~ No. 68 (Revised) and described in Exhibit "A" attached hereto and 8 incorporated herein by this reference as though set forth herein ii f ~1 and ~FHEREAS, the Local Agency Formati'on Commission, in 10 session' duly assembled, on February 9, 1972, did approve said pro- of the City of Tustin did pass and adopt Resolution No. 72-11 giving notice of the proposal to annex certain uninhabited territo.r~f 15_ to the City of Tustin, said territory being therein designated as Prospect-Irvine-Newport Annexation No. 68 (Revised) said Resolution 14 describing the boundaries of the territory to be annexed; ~nd 15 WHEREAS, said Resolution contained a notice of the day, " hour and place when and where the Council o~ the City of Tustin 16 would hear protests made by any person owning real property withi~ the territory proposed to be annexed, the time of said hearing 1~ being prescribed by' law; and · 18 WHEREAS,' on the 3rd day of April, 1972 at the hour of 7:30 o'clock, P.M., in the Council Chambers, 275 South "C" Street 19 in the City of Tustin, County of Orange, State of California, sa.~id time and place being the day, hour and place fixed in said Resolutjof 20 for hearing protests to the said annexation, the said City Council did continue said hearing to April 18, 1972 and did on that date ~1 hear and pass upon all protests made to the proposed annexation an~ did determine that protests had not been made by the owners of one-half of the value of the privately and publicly owned E5 territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the. City of Tustin, and is uninhabited territory in the County of Orange; ~5 NOW, THEREFORE, the said Council of the City of Tustin, 26 does hereby approve the annexation of the territory hereinafter described to the City of Tustin and does hereby further ordain ~7 that said territory be and it is hereby annexed to the City of l I~, Tus tin. S8 That said territory, the annexation of which to ~he ~9 City of Tustin is hereby approved, is all the territory situate in the County of Orange, State of California~ mo~eparticularly 50 described in Exhibit "A" attached hereto and made a part hereof 51 by this reference. PARCEL 2: An easement for community driveway purposes over the Southerly 7.50 feet of the following: Beginning at the intersection of the centerlines of Preble and Poplar Avenues, as shown on a map of Rice's Addition, recorded in. book 19, page 26, Miscellaneous Recoo~ds of Los Angeles County, California, being also 30.00 feet East of the Northeast corner of Block 5 of Rice's Addition to Tustin, as shown on a supplementary map~ recorded in book 36, page 25, Miscellaneous Records of said Los Angeles County, California, and running thence West 555.00 feet; thence South 344.05 feet; thence East 555.00 feet; thence North 344.Q5 feet to the point of beginning.
