HomeMy WebLinkAboutORD 517 (1971) ORDINANCE NO. 517 1 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA AMENDING THE TUSTIN CITY CODE RELATIVE TO BUILD- ~ ING REGULATIONS, AND ADOPTING THE 1970 UNIFORM -' BUILDING CODE, 1970 UNIFORM MECHANICAL CODE AND ~" 1970 UNIFORM PLUMBING CODE. 4 The City Council of the City of Tustin, California, does hereby ordain that the Tustin City Code is hereby amended as follows: 1. Article II, "Building Code", of Chapter 6 of the. Tustin City Code,'is hereby amended to read as follows: 10 Article II - Buildin9 Code Sec. 6-3 Adopted 11 For the purpose of prescribing regulations for the 12 erection, construction, enlargement, alteration, repair, moving removal, conversion, demolition, occupancy, equipment, use, height 13 and area of building structures, all of the provisions of the 1970 edition of the Uniform Building Code, adopted and published by the 14 International Conference of Building Officials, including the appendix thereto, and excepting Chapter 70 thereof, of which not 15 less than three (3) copies have been and now are filed in the office of the City Clerk of the City oftTustin, are hereby adopted ~' 16 and incorporated herein as fully as though set forth in full herein save and except such portions as are hereinafter deleted, modified 17 or amended. I8 Sec. 6-3.1 Amendments, Additions and Deletions 19 The 1970 edition of the Uniform Building Code is hereby amended as follows: ' 20 (a) Section 205 ~he second paragraph of Section 205 is hereby deleted, and the following paragraph substituted therefor: Any person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemean6r and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any viola- tion of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable as for a violation of the Code of the City of Tustin. (b) Section 303 29 Section 303 is hereby amended to read as follows: '\ Section 3-03 Building Permit Fees. A fee for each 30 building permit shall be paid to the Building Official as set forth by resolution of the City Council. 31 I 2. Article IV of Chapter 6 of the Tustin City Code is Z hereby amended to read as follows: ~ Article IV - Mechanical Code 4 Sec. 6-5 Adopted 5 For the purposeof requiring permits for and providing rules and regulations for the protection of the public hea~th and 6 safety, and establishing minimum regulations for the installation, alteration, design, construction, quality of materials, location, V operation and maintenance of heating, ventilatihg,.. comfort cooling refrigeration systems, incinerators, and other miscellaneous heat- 8 producing appliances, and the inspection thereof, all of the pro- visions of that certain Code, known as the "Uniform Building Code, 9 volume 2", also known as the "1970 Uniform Mechanical Code", including the appendix thereto, of which not less that three (3) 10 copies have-been and now are filed in the office of the City Clerk of the City of Tustin, are hereby adopted and incorporated herein, 11 as fully as though set forth herein, save and except such portions as are hereinafter deleted, modified or amended. Sec. 6-5.1 Amendments, Additions and Deletions -13 The 1970 Uniform Mechanical Code is hereby amended as 14 follows: 15 (a) Section 202 16 Amend second paragraph of Section 202 to read as follows: 17 Any person, firm, or corporation violating any of 18 the provisions of this Code shall be deemed guilty of a misdemeanor and each'Such person shall be deemed guilty of aseparate offense 19 for each and every day or portion thereof during which any violatioz of any provisions of this Code is committed, continued, or permitte, 20 and upon conviction of any such violationSuch person shall be punishable as for a violation of the Code ofthe City of Tustin? (b) Section 304 .... ' ' Section 304 is hereby amended to read as follows: \\~J 23 Section 304 Mechanical Permit Fees. A fee for 24 each mechanical permit shall be paid to the Building Official as set forth by resolution of the City Council. (c) Section~lg01 To Sectionlg01, add a new subsection (c) to read ~? as follows: 28 ,-- (c) Kitchen Ventilation 29 "There shall be installed in the wall or ceiling, approximately over the cooking facilities, a ventilating 30 opening with a minimum area of eight inches by six inches (8" x 6") · ' connected by an incombustible ventilating duct free to the outside 31 of the building. The. ventilating duct for each kitchen, shall have a minimum cross-sectional area of twenty-eight square inches (28 sq. 32 in.). An approved fOrced-draft system of ventilation may be sub- stituted for the natural draft ventilating systemS" I 3. Article V of Chapter 6 of the Tustin City Co~e is hereby amended to read as follows: Article V - Plumbing Code Sec. 6-6 Adopted For the purpose of requiring permits for providing rules 5 and .regulations for the Protection of the public health and safety, and establishing minimum regulations for the installation, alter- 6 ation, design, construction, quality of materials, location, operation and maintenance of plumbing, piping, drainage systems V and private sewer and disposal systems and the inspection thereof in the City of Tustin, all of the provisions of that certain code, 8 known as the 1970 edition of the Uniform Plumbing Code, including the appendix thereto, of which not less than three (3) copies have 9 been and are now filed in the office of the City Clerk of the City of Tustin, are hereby adopted and incorporated herein, save and 10 except such portions as are hereinafter deleted modified or amended. · 11 Sec. 6-6.1 Amendments Additions and Deletions 12 ~ ' The 1970 edition of the Uniform Plumbing Code is hereby 13 amended as follows: 14 (a) Section 1.1 15 Section 1.1 Administrative Authority and Assistants ~' 16 is hereby amended to read as follows: Whenever the term "administrative authority" is _ used in this Code, it shall be construed to mean the Building 18 Official of the City of Tustin, or his authorized representative. 19 (b) Section 1.2 ' Section 1.2 Assistants is hereby amended to read 2'0 as follows: 21 Whenever the term "assistants" is used in this Code, it shall be construed to mean the senior plumbing inspector, 2~ plumbing inspector, or other inspector of the Building Department 23 the City of Tustin. (c) Section 1.3 Section 1.3 Department Having Jurisdiction is Z5 hereby amended to read as follows: 26 Unless otherwise provided for by law, the office. of the Administrative Authority shall be a part of the Building 27 Department of the City of Tustin. /~ ~8 (d] Section 1.7 =~ 29 Section 1.7 Violations and Penalties is hereby 30 amended to read as follows: Any person, firm or corporation violating any of the . 31 provisions of this Code shall be deemed guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for 32 each and every day or portion thereof during which any violation i of .any provisions of this Code is committed, continued, or permitted, and upon convictionlof any such violation such person ~ shall be=punishable as for a violation of the Code of the City 3 of Tustin. 4 (e) Section 1.12 Section 1.12 is amended by deleting the "Schedule 5 of Fees"' and adding a new paragraph to read as follows: ~ A fee for each Plumbing permit shall be paid to the V Building Official as set forth by resolution of the City Council. 8 (f) Section 1008 (c) (1) 9 Section 1008 (c) (1) is amendedto read as follows: 10 (1) Non-metallic and ferrous piping shall be prohibited; except that ferrous piping four (4) inches and larger 11 may be used when protected against corrosion and installed in channels, tubes or in similar protective manner when approved by 12 the Administrative Authortiy. Cast iron pressure water piping excepted. 13 (g) Section 1009 14 SeCtion 1009 (h) is amended by changing the second 15 paragraph to read as follows: 16 --No building supply pipeline shall be less than one inch (1") diameter for each single family residential structure. 17 Each main building shall have a minimum of two (2) three-quarter (3/4) inch hose bibbs located one readily accessible. to the front 18 yard..and one readily accessible~to=the rear yard. 19 (h) Table 10-2 ~0 Table 10-2 is amended by changing'the double asterisk footnote to read 'as follows: Z1 ** Building Supply - 3/4" minimum - 1" minimum for ZZ each Single family residential structure. 4. The City Clerk shall certify to the passage of this Z5 Ordinance, and shall cause the same to be published once within 24 fifteen (15) days after its adoption, in the Tustin News, a newspaper of general circulation, printed· published and circulated Z5 in said City· and immediately.upon and a-fter its passage it shall take effect and be in full force. 26 PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin, held on the 4th day of October, 1971.
