HomeMy WebLinkAboutORD 504 (1971) ORDINANCE NO. 504 2 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE RELATIVE TO 3 REGULATION OF LARGE GATHERINGS OF PEOPLE 4 The City-Council of the City of Tustin, California, 5 does ordain that the TustinlCitY Code be amended by the addition 6 thereto of Sections 8-28 through 8-37 to read as follows: ? 8-28 8 NO person shall organize, advertise, conduct, establish, maintain, carry on, set up, assist, or participate in 9 any outdoor gathering of,or proposed to be of, more than five hundred (500) persons for any.purpose, including but not limited 10 to any festival, music festival, dance festival, public dance, show, street dance, parade, exhibi.tiOn, fair or any other gatherin~ 11 related or unrelated to any of the foregoing, without a permit therefore first having been issued by the License and Permit Board 12 provided, howeverv that there are excepted from the provisions of this section the following: a) carnivals and'.ci~r'C~'ses for which permits have been i4 granted by the L~=C~..~se and Permit Board; 15 b) sports and other events 'conducted on public school premises with approval of school authorities. 16 c) Events sponsored by City. ' 17 8-29 18 Application for such a permit shall include: 19 a) The address and legal description of the premises upon which the gathering is proposed; 20 b) Copies of all leases, licenses, contracts and other 21 consents of the owner or owners of the premises; 22 ' c) The names, addresses and financial statements o~ all promotors, organizers, presenters, proprietors 29 and financial backers of the proposed gathering; 24 d) The hours and dates of the proposed gathering; 25 e) A detailed description of the program, agenda or plan of activities of the proposed gathering; f) A statement of the estimated minimum and estimated 27 maximum number of persons who may reasonably be expected to attend the proposed gathering; 28 g) A detailed description of each of the following 29 items proposed by the applicants for the proposed gathering: 50 1) A copy of each proposed advertisement and a 51 description of all proposed publicity; ,~2 '2) A plan of the proposed access and traffic flow NORTH I)It~OADWAIF i routes of ingress and egress together with pro- ,. posed directlonal signing; traffic barriers, Z traffic control officers and pedestrian control officers. ..~ 3) A proposed 'parking plan; 4 4) A proposed sanitation plan, including provision · . ~ 5 for toilets and drinking water; '~ 6 5) A proposed plan for medical first aid assistance ~ 6) A proposed plan for fire protection; 8 7) A description Of existing or proposed physical improvements, including fences, gates, ticket 9 booths, stages, light and sound towers, grand- stands, food. vending and ether booths. 10 · 8) A proposed plan of 6leanup of the premises, 1I .adjacent areas and routes of access for ingress and egress; 12 9) A proposed plan for providing food and drinks; 15 ' 14 10) A proposed plan .for illumination of all areas of the premises'and of routes of access for 15 ingress and egress. .-~ -~6 11) A proposed plan of dust control of all areas of the.premises and routes of access for ingress 17 and egress; 12) A proposed plan of sound amplification systems. 18 19 8-30 20 The License and Permit Board shall determine the reasonab.!e estimated cost to the City for the extra services likel}. Zl to be causedby the pr. oposed gathering by reason of, but not limited to, extra traffic conerol officers, extra crowd. control 23 pay all auch costs and post with the City cash deposits! in an amour, )~ equal to such estimated costs. 25 8-3~ 26 All applications shall be submitted to all affected departments of the City for. their investigation, report and recom- 27 mendat!on. 28 8-32 29 All permits issued pu.rsuant to these provisions shall specify in details 50 a) Each of the conditions upon which the permit is 31 i slsue d; 32 b.) The detailed pro-visior~for the items specified in ~,,,,K.-~HoL,,.oo~ section 8-2!~, =g):, 1) through~-12). 1~ c) The maximum number of persons to be permitted to gather, and d) The amount of cost-security deposit to be required. e · b Upon a determination of the necessity or d s'ra tll~y therefor by the License and Permit Board, or upon request by the applican~s and approval thereof by the License and Permit Board, the applicants shall provide, at their sole cost, all or any part 7 of personnel and equipment for traffic control. crowd control, traffic barriers, fire protection services and cleanup services. 8 8-34 9 Illumination, dust and sound shall be controlled in 10 such manner so as not to be likely to constitute a nuisance or annoyance to adjacent properties or persons and all permits shall ii provide reasonable conditions to prevent .such annoyances. 8-35 13 No person shall advertise, announce or cause or assist in the advertising or announcement of any gathering or pro- 14 posed gathering prior to a permit having been regularly issued therefor by the License and Permit Board. by any means or medium. 15 including but not limited to pamphlet',. poster, handbill, billboard. sign, newspaper, magazine, radio and telev. isiO~ No person shall 16 print. distribute, broadcast, announce, use", '~'~ cause or assist i any printing, distributing, broadcasting or announcement of any 17 advertising of a proposed gathering which has not been approved b the License and Permit Board. 18 8-36 ~9 No person shall advertise, promote or announce within 20 the City any gathering of persons proposed to be held outside the City, if such proposed gathering has not been regularly licensed Zl accordance with the ordinances, statutes and regulations of the jurisdiction within which the gathering is proposed. 8-37 No person engaging in, participating in or attending any gathering for which a permit has not been granted shall fail to leave the area of such gathering upon demand by any police officer of the City. 26 8-38 27 It shall be unlawful for any person to enter, to attempt to enter, or to assist any other person to enter, or to 28 atteml~t to enter, any theatre, fair, festival, moving picture the~tr athletic contest, place of amusement, place of entertainment, lec' 29 or place of assemblage in the City of Tustin, for entrance of whi~ an admission fee is charged or demanded, or ticket or permit to ~0 enter is required, without having paid such admission fee or with- out having surrendered or displayed such ticket or permit, unless 3! such entrance is made with the ex~re'ss consent Qr a~proval 02 the owner, propzietor or management of the place '~neere8 Or sought to 32 be entered , - ...... , ......... ~,~,! ~ ~.f!/j-%. !,-=~,~., .~ ~ -. i'! - Whenever two or more persons gather together in su a manner as to obstruct the free passage of any street, sidewalk, alley, public way or place used by members of the public to go fr place to place, such persons shall move on or disperse when order, to do so by a police officer. No person shall refuse or fail to disperse or move on when directed to do so by a police officer. NO person shall stand. sit, linger, idle or loiter any street. alley, sidewalk, park or other public place, or in or about the entrance or exist of any business establishment, either on foot or in an automobile or other vehicle, in such a manner as to obstruct or hinder the free passage of persons along such publ~ way. or obstruct or hinder persons entering and exiting from any business establishment. For the purpose of this section. "business estab- lishment" shall mean any retail store, food market, theatre, res- taurant, drive-in restaurant, gasoline service Station, bar, hotel motel or any other establishment which is open to and provides the public with any goods or s'ervices. 8-40 No person shall maintain, operate or cause to be maintained or operated in the City. any loudspeaker or sound ampli- fier in sdch manner as to-cause sound to be projected therefrom, outside of any building or out of doors, without first procuring a permit so to do from the Chief of Police. The Chief of Police may issue a permit to any per- son applying therefor for the use of a loudspeaker or a sound amplifier to project sound outside of any building or out of doors in any part of the City in the following cases onlyz 1) The making Of charitable appeals. 2) During and as a part of public events; 3) In publishing affairs of interest to the genera] public; provided that no permit shall be issued for the use of such loudspeakers or sound ampli- fiers in commercial advertising, except when issued under paragraph 4). 4) Where the announcement or broadcasting is in connection with public events such as coremen!a! games or public amusements and when the announce sent or broadcasting is made for the information= or amusement of the persons assembled at such ceremonials, games or amusements. The permit as issued by the Chief of Police shall state the name and address of the permittee, the authorized purpose thereof. the time and place of using such loudspeaker or sound amplifier. shall contain limitations to protect the quiet enjo}.-nentJ of other persons. and shall be revocable at any time. The provisions of this section shall not apply to radio receiving sets permanently installed in private automobiles receive programs broadcamted from regularly licensed and establish~:,.! 1 radio stations for the pleasure and entertainment of the occupants of such automobiles; provided that the reception shall not be amplified beyond the reasonable necessities of the occupants of such automobiles; or to radio receiving sets installed in any dwelling house to receive programs broadcasted from regularly licensed and established radio stations for the pleasure and 4 tainment of the occupants of such dwelling houses.; or to radio receivin~ sets established or maintained in stores indoors to demonstrate radios that they carry for sale; provided that the reception shall not be amplified beyond the reasonable necessities 6 of such indoor demonstration. ~ PASSED AND ADOPTED at a regular meeting of the City 8 Council· held on the 5th day of April , 1971.- II ATTEST: 15 16 17 18 19' 20 Zl 22 Z5 26 29 50 51 32 JGR:rg 2-24-71 STATE OF CALIFC~I~NiA ) COUNTy OF OI~NGE ) SS CITY OF TUSTIN ) RUTH C.
