HomeMy WebLinkAboutORD 461 (1970)I 2 4 5 6 7 8 9 10 11 ORDINANCE NO, 46) AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING REGULATIONS FOR MOBILE X-RAY UNITS. The Council of the City of Tustin, California, does hereby ordain as follows: Section 1. Regulations: Scope. All mobile x-ray units shall comply with the requirements of the Radiation Control Law, Division 20, Chapter 7.6, California Health i and Safety Code, together with regulations enacted pursuant thereto. Section 2. Definitions. "Mobile X-ray Unit" means any x-ray generator which is, or 12 can be, used for the purpose of making medical diagnostic photo - 13 flurographic films of persons, and which is installed in or upon a 14 motor vehicle or trailer so that it may be transported from place 15 to place. 16 "Mobile X-ray operator" means any person, or other entity, 17 who owns or legally possesses, or operates, a mobile x-ray unit. 18 Section 3. Regulations: Investigation. 19 Any person or entity desiring to operate a mobile x-ray unit 20 within the City of Tustin shall make application to the County Healt 21 Officer on forms prescribed by him for issuance of a license. The 22 County Health Officer shall cause to be conducted an investigation 23 of said applicant for a license to determine, among other things, th 24 following items of information: 25 a) Whether or not said unit has a valid state registra- tion as provided by Division 20, Chapter 7.6, Californi 26 Health and Safety Code. 27 b) Whether or not said applicant has complied with appli- cable laws, ordinances, and regulations, including thos 28 relating to the reporting to the Health Officer of 29 abnormal x-ray findings pursuant to regulations of the State Department of Public Health. 30 c) Whether the proper public notices,,as required by state 31 law, regulations enacted pursuant thereto, and local ordinances, have been posted in or upon the mobile unit. 32 ROURKE& HOLBROOK ATTORNEYS AT LAW CROCKER-CITIZENS BANK BUILDING 900 NORTH BROADWAY SANTA ANA, CALIF. TELEPHONE 647-6181 R 1 2 d) The location and mailing address of all film files be maintained by said mobile unit as hereinafter provided. 3 e) Whether the applicant and his specified personnel are qualified by reason of training and experience 4 operate a mobile x-ray unit in such a manner as to provide reasonable assurance of protection to heal 5 life, and property. 6 f) Whether the applicant's equipment, facilities, propo uses and procedures are such as to provide reasonabl 7 assurance of protection to health, life and property 8 g) Such other information as shall be required by the County Health Officer. 9! 1011 Section 4. Regulations: License. 11 No license shall be granted, renewed, or reinstated unlet 12 the County Health Officer determines, upon completing his investi- 13 gation, that the mobile x-ray unit is, or can be, operated in com- 14 pliance with applicable laws, ordinances, and administrative regula- 15 tions, and in a manner not detrimental to the health of the patrons, 16 employees, and the general public and that all operations of mobile 17 x-ray equipment have been certified by the County Health Officer to' 1811operate same. 19 Section 5. Regulations: Duration. 20 Licenses may be granted at any time during the year, but 21 all licenses shall expire at the end of the calendar year. 22 Section 6. E!849%OH8& 547-6181 a) is No person under the age of fifteen (15) years is to be x-rayed unless such person has had a positive tuber -1 culin skin test and presents a written statement, signed by a licensed practitioner of the healing art, showing the method and the date of such positive ski test. A sign shall be posted in a prominent locatio of the mobile x-ray unit stating that no person undei the age of fifteen (15) years is to be x-rayed unlesA such person has had a positive tuberculin skin test.) b) No pregnant women shall be x-rayed in a mobile x-ray unit unless so ordered in writing by a licensed practitioner of the healing arts. TELEPHONEICEMiMa I c) The mobile x-ray operator shall require all persons, before being x-rayed, to complete,an information form showing the following: Name, age, sex, address telephone number, the person's physician's name and address, if a female, whether pregnant, if under. fifteen (15) years of age, whether the person has ha a positive tuberculin skin test, and the date of suc test. d) All x-ray films shall be retained by the operator f at least ten (10) years. Each patient 'shall receive from the mobile x-ray operator a report of his x-ra, findings within thirty (30).days. Every thirty (30 days, the operator shall submit to the Health Offic4 a report of the total number of x-ray films taken during the preceding calendar month. e) The mobile x-ray operator shall make x-ray films available for use by the physician of the person x- rayed, provided said person gives his consent in writing. The operator may make a reasonable charge for such service. f) A sign shall be posted in a prominent location on th mobile x-ray unit stating essentially the following: "A chest x-ray film is a useful aid to the physician in diagnosing chest disease. It is not a complete examination. See your family doctor for an examina- tion at least once a year." The County Health Offic shall have the right to determine the location, size and wording of all required signs. g) The mobile x-ray operator shall give the County Health Officer notice at least fourteen (14) cale days in advance concerning proposed dates, times, places of use of the unit. All such information will be forwarded by the County Health Officer to City of Tustin. h) The name and address of the mobile x-ray operator shall be plainly printed on each side of the exterio of the vehicle or trailer in letters at least three (3) inches high. The name and address of the mobile x-ray operator shall appear on all forms, letters, pamphlets, or other printed matter used in conjunc- tion with the unit. Neither sign nor printed matter shall contain any statements expressed or implied that the mobile x-ray unit is associated with any health department or other public or private health agency. i) The mobile x-ray operation shall comply with all applicable city ordinances and resolutions while operating within the City of Tustin.. Section 7. Regulations: Operation. No mobile x-ray unit shall be operated unless the operat thereof has been licensed as hereinbefore provided.
