2 AN ORDINANCE OFTHE CITY OF TUSTIN, CALIFORNIA,
AMENDING THE TUSTIN CITY CODE RELATIVE TO
UNDERGROUND UTILITIES.

The C'ity'.z:Council..of the City of Tustin does hereby
ordain as follows: '
Section 6-4,5 is hereby added. to the Tustin City Code,

to read as follows:

a) Whenever any property in any zone is developed with
10 new or relocated buildings or structures, or whenever enclosed floor area
in excess of 200 square. feet is added to an existing building site in any
11 zone except zones permitted for single family residential use, or whenever
a new electrical~service is.installed in an existing building, in any
12 zone except zones permitt'ed for.+single family residential use, or whenever
a residential building or use is converted to.any purpose or use other
15 than that which existed at the time~of conversion, all electrical, tele-
phone, community anten.na television and similar service wires or cables,
14 which provide direct service to the property being developed, shall,
within the exterior boundary lines of such property, be installed
15 underground.
16 b) For the putposed of this Section, appurtenances and
associated equipment such as, but not limited to, surface mounted trans-
17 formers, pedestal mounted terminal boxes and meter cabinets,.may be
placed above ground°

c) The developer or owner is responsible for complying
19 with the requirements of this Section, and shall provide all necessary
facilities on their premises so as to receive such services f~om the
20 Supplying utility or utilities~subject to the applicable rules, regu-
lations and tariffs of therespective utility or utilities on file .with
21' the California Public Utilities COmmission.

d) Where practical difficulties or unnecessary hard-
ships inconsistent with the purposes of this Chapter result from its
literal interpretation or enforcement, the Planning C~aission may
waive, modify, orLdelay the application of any undergro~n~ding require-
ment upon written request by a building site owner. Such request shall
be filed with the Planning-Commission and shall contain any and all
facts which are offered in-support.
26 e) If the Planning Commission's action is to delay the
installation of r~quired underground utilities, it may require the build-
27 ing site owner to. file with the City a cash deposit, and/or record a
" covenant sufficient to provide for the future installation of the under-
28 ground features which are to be delayed. The amount of the cash deposit
shall be determined by the Building Official.
