REZONING PROPERTY ON APPLICAT!ON Z.C. 69-189 OF
PAUL B. TREAT.
~ The City Council of the City of Tustin, California, do~s
5 hereby ordain as follows:
6 1. The City Council ~inds and determines:
? a) That a proper appl.ication (No. Z.C. 69-189) was
filed on behalf of Paul B. Treat to rezone, from
8 the PM, (Planned Industrial), and M (In~ustria!)
districts, to the R~3-1750 (Multiple Residential
9 1750 square feet of lot area per dwelling unit)
district, the property described in Exhibit A
I0 attached herein by this reference.
1t b) That a public hearing was duly called, noticed
and held by the Planning Commission on said
12 application.
13 c) That the Planning Conunission 'regularly recommende
denial of said application.

d) ThRt the City Council duly called~ noticed and
held a puJD!ic hearing on said application.
' 16 e) That said rezoning should be granted.
1V f) The proposal would eliminate industrially zoned
land from an area designated for multiple family
~8 residential use.
19 g) The increase in ~ensity over that designated on
~he Cenera! Plan is justified by the proximity
20 to the Flood Control Channel and the mainline
21 tracks of the A.T.'& S.F.
2. The subject property is hereby rezoned to the R-3
23 1750 (Multiple Residential, 1750 square feet of 10t area per
dwelling unit) district, subject to the following conditions:

a) That plans for water lines fire hydrants access
and fire extinguishers be subject to the approval
of the Fire Department.
b) Dedication of street right-of-way in accordance
~ 27 with the Master Plan o~ Arter~.al Highway plus a
~ 28 cu.l-de-sac at the end of Newport Avenue.
c) Grant sufficient right-of-way and construct stree~
29 improvements for a cul-de-sac at the end of
Car fax Avenue to the satisfaction of the~ City
30 Engineer. Access rig'hts shall be given to the
31 City .and used for emergency access
d) Installation of asphalt pave~ent,' curb, gutter an
32 sidewalk.
