AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA,
PREZONING PROPERTY ON APPLICATION NO.PZ 68-111
OF BOLYARD
5 The City CouHcil of the City of Tustin, Californi.a,
~- does Ordain as follows:
5 - 1) The City' Council ' finds and determines:
6 a) That a proper application (No. PZ 68-111)' w.as
filed on behalf of BOLYARD for prezoning to the
V R--3 (Multip].e Family Residential) Zone all the
8 property described in Exhibit A, attached here-
to and incorporated herein by this reference;
9 b)' That the Planning Commission duly called, noticed
10 and held a public hearing on said application;
11 c) That the Planning Cor:nnission recommended denial
of said application;
12 d) That said property should be prezoned.
1~ 2.) The subject property i.s hereby rczoned to the R-3-
-].~ 1500 (Multiple Family Residential 1500 square feet of lot area per
15 dwelling unit), effective upon annexation to the City of Tustin,
16 subject to the following conditions:
· lV a)' That an agreement in form satisfactory to the
City Attorney be entered into by the property
18 ov.~ner, limiting d.evelopment to one--story with-
.t9 in 150 feet of any property line abutting the
R-1 District, and requiring not less than tv:o
parking spaces per dwelling unit, with at least
20 one of the parking spaces pe~: each unit being
21 covered..
~ b) At the time ~f deve!opme~t Of said property,
Bolyard will dedicate and improve, for public
highway purposes, such portion of the aforesaid
2[5 property, a standard cul-de-sac at the north end
24 of existing Myrtle Avenue, together with a rigb. t-
of-way for a standard sixty-foot local street,
and for knuckles to provide a reasonable direct
25 connectj. on between the present terminus of Nisson
Road and the .terminus of the easterly extension
26 of Pasade:aa Avenue. Precise a!lignr:'~ent of this
street shall be proposed by Bolyard, and is
27 subject to the approval_ of the Tustin City Eng-
ineel and the Tusitin Fire Chief; and granting to
28 Tustin a full right of access for ingress and
29 eg~:ess for public emergency vehicles only to the
cul-de-sac' ~o be censtructed at the end of the,
30 existing Myrtle Avenue.

line of said Lot "X", 786.~0 fect~ to the Northwest corner of that certain
parcel of land as conveyed to Glenn R. Bolyard and. tlazel G. Bolyard by deed re--
corded in Book 2776, page 200, Official Records of Orange County, California;
thence N.89°49 '20" E. along' the North lin~ of said land and its easterly pro~
longation 358.35 feet to the Southeast corner of tbat certain parcel of land
as conveyed to the State of California by deed recorded in Book 25].5, page 128~
Official Records of said Orange County; thence North, 10.83 feet, along the
East line of said land to its intersection ~,Tith the Northwesterly prolongation
of the South line of Nisson Road, 50.00 feet ~qide, as shown on a map of Tract
No. 5415~ recorded in BOok 210, pages 45, 46 and 47, Miscellaneous Maps, Records
of said Orange County; thence S.67°32'34"E., 101.74 feet, along said North-
westerly prolongation to the Northwest corner of said Tract No. 5415 and to that
certain compromise line between Lots "X" and "Y" of said Stafford and Tustin
Tract, described in a deed recorded January 16, 1928 in Book 126, page 53 of
Official Records of said Orange County; thence S.00°12'40"E., 765.72 feet, along
said compromise line and along the West line of said Tract No. 5415 to the South-
- ~.:est corner of said Tract No. 5415 and to a point on the South line of said Lot
"X" thence S.89°47'00'W., 452.94 feet, along the south line of said Lot '~X" to
the point of beg.inning.

Council of the City of Tustin, held on the 4th day of November 1968.
