HomeMy WebLinkAboutORD 396 (1968) ORDINANCE NO. 396 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "PASADENA AVENUE AND MC FADDEN AVENUE ANNEXATION" TO THE CITY OF TUSTIN, CALIFORNIA BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TUSTIN WHEREAS, on the 1st day of April, 1968, the Council of the City of Tustin did pass and adopt Resolution No. 934, giving notice of the proposal to annex certain uninhabited territory to the City of Tustin, said territory being t~erein designated as "PASADENA AVENUE AND MC FADDEN AVENUE ANNEXATION" said Resolution describing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution contained a notice of the day, hour and place when and where the Council of the City of Tustin would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being as prescribed by law; and WHEREAS, on the 15th day of April, 1968 at the hour of 7:30 o'clock, P.M., in the Council Chambers, 275 South "C" Stree~in the City of Tustin, County of Orange, State of California, said time and place being the day, hour and place fixed in said Resolution for hearing protests to the said annexation, the said City Council did hear and pass upon all protests made to the proposed annexation and did determin~ that protests had not been made by the owners of one-half of the value of' the privately owned territory proposed to be annexed, as shown by the last equalized assessment roll, nor by public owners of one-half of the value of the publicly owned territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the City of Tustin, and is uninhabited territory in the County of Orange; NOW, THEREFORE, The said Council of the City of Tustin does hereby approve the annexation of the territory hereinafter described to the City of Tust[n, and does hereby further ordain that Said territory be and it is hereby annexed to the.City of Tustin. That said territory, the annexation of which to the City of Tustin is hereby approved, is all the territory situate in the County of Orange, State of California, more particularly described as follows: Beginning at an angle point in the existing boundary of the City of Tustin, California, as established.by the "South Tustin Avenue Annexation" by Ordinance No. 136, dated July 5, 1960, said angle point also being the Southeast corner of that certain parcel of land conveyed to William S. Hatch and Elizabeth Hatch by deed recorded in Book 1816, Page 134, Official Records of Orange County, California; Pg. I thence West along said City boundary and along the South line of said Hatch parcel and its Westerly prolongation, 5?9.40 feet, to the West line of Tustin Avenue, 50.00 feet wide, and to the existing boundary of the City of Santa Ana, California, as established by the "McFadden and Tustin S.W. Annex" by Ordinance NS No. 406, dated October 5, 1959; thence North departing from said boundary of the City of TuStin, along said boundary of the City of Santa Aria and along the West line of said Tustin Avenue, 42?.40 feet, to an angle point in said boundary of the City of Tustin as established by said Ordinance No. 136, and to a point on the Westerly prolongation of the North line of said Hatch parcel; thence East departing from said boundary of the City of Santa Ana, along said boundary of the City of Tustin and along said North line and its Westerly prolongation, 579.40 feet, to the Northeast corner of said Hatch parcel; thence South along the East line of said Hatch parcel,'~427.40 feet, to the point of beginning.
