HomeMy WebLinkAboutORD 386 (1968) ORDINANCE NO. 386 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED RED HILL AVENUE - COMO ROAD ANNEXATION (REVISED) TO THE CITY OF TUSTIN, CALIFORNIA. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TUSTIN: WHEREAS, on the 18tb day of December, 1967, the Council of the City of Tustin did pass and adopt Resolution No. 918, giving notice of the proposal to annex certain uninhabited territory to the City of Tustin, said territory being therein designated as "RED HILL AVENUE-COM0 ROAD ANNEXATION (REVISED)~, said Resolution describing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution contained a notice of the day, hour and place when and where the Council of the City of Tustin would hear Dr?tests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being not less than forty (40) nor more than sixty (60) days from the date of passage of said Resolution; and WHEREAS, on the 5th day of February, 1968, at the hour of 7:30 P.M., in the Council Chambers, 275 South "C" Street (corner of Third St.), in the City of ITustin, County of Orange, State of California, said time and place being the day, hour and place fixed in said Reso~ution for hearing protests to the said annexation, the said City Council did hear and pass upon all protests made to the proposed annexation, and did determine that protests had not been made by the owners of one-half of the value of the privately owned territory proposed to be annexed, as shown by the last equalized assessment roll, nor by public owner~ of one-half of the value of the publicly owned territory pro~pse~ to be annexed, as deter- mined by said legislative body; and WHEREAS, said ter~ri~tory is contiguous to the City of Tustin, and ~is unin- hab~ted t~rritory in the County~ of Orange; NOW, THEREFORE, the said Council of the City of Tustin d~es hereby approve the annexation of the territory 'b~reinafter described to the City Of Tusttn, and does hereby further ordain that th~ sA~d territory~be and it is hereby annexed to the C~ty ~f ~ustin. That said territory, the annexation of which to the City of Tustin is hereby approved, is all that territory situate in the County of Orange, State of Californ~a, more particularly described as follows: Beginning at an angle point in the existing boundary of the City of Tustin, California, as established by the Red Hill - Walnut Annexation by Ordinance No. 343, dated March 20, 1967, said angle point being the intersection of the~North- westerly line of Lot 62, Block 11 of the Irvine Subdivision as per map recorded in Book 1, Page 88 of Miscellaneous Record Maps in the office of the Coun~y~' Recorder of Orange County, California, with the Northeasterly right of way line of the Atchison, Topeka and Santa Fe Railway C~anFright e~ way, 100 fee~ wide, thence South 5)o 10' 59" East along said City boundary and along said North- easterly right of way line 1,320 feet, more or less, to the intersection of said Northeasterly_right of way line with the Northeasterly prolongation of the South- easterly line of Lot 67, Block lO of sa.td Irvine Subdivision; thence South 40°·I02"59'' West, departing from said City boundary, along said Southeasterly line of Lot 67 and its prolongation 1,370.15 feet to the South corner of said 'Lot 67; thenceNorth 50° 10' 50" West along the Southwesterly line of said Lot 67 ?a distance of 1,320 'feet, more or less to the West corner of said Lot 67 and'tO "' the South corner of Lot 66, Block l0 of said Irvine Subdivision; thence continuing North 50o lO' 50" West along the Southwesterly line of said lot 66 to a line!which is parellel with and 50.00 feet Northwesterly, measured at right angles ·from the Southeasterly line of said Lot 66, said parallel line being the existing' boundary of the City of Tustin, California, as established by the Red Hill - Valencia Annexation by Ordinance No. 290, dated September 7, 1965; thenc~e North ~O° 00' 00" East along ~aid City Boundary and along said parallel line 351.10 feet to a point on the existing boundary of the City of Tustin estab- lished by the Warner-Sycamore Annexation by Ordinance No. 245, dated December 2, 1963, saidpoint also~being on the Northeast line of the Southwest 351.10 feet of Lot 66 of said Block lO; thence South 50° lO' 50" East 50.00 feet along said Warner-Sycamore Annexation, also being along said' Northeast line of said Southwest 351.10 feet of said Lot 66, to a point on the Southeast line of said Lot 66, said Southeast line also being the centerline of Red Hill Avenue; thence North 40Q 02' 59" East 530 feet, more or less, along said Warner- Sycamore Annexation, also being along the Southeast line of said Lot 66 to the Southwest line of Edinger Avenue (80 feet wide); thence North 50° 10~ 50" West 755.76 feet along said Warner-Sycamore Annex- ation, also being along said Southwest line of Edinger Avenue to the Southwesterly prolongation of the Northwest line of that certain parcel of land conveyed to Mullin Lumber Company by deed recorded in' Book 4909, Page 154, Official 'Records~ of Orang~ County, California; ..... Ithence North 39° 49' lO,' East 480.100 feet along said'Warner-Sycamore Annexation, "" also bein~ along said Southwesterly prolongation and along said Northwest line and . the Northeast prolongation thereof to a point on the Northeast right of way line of the Atchison, Topeka and San-ta Fe Railroad (lO0 feet wide); thence South 50° lO' 50" East 755.76 feet along said' Warner-Sycamore Annexation, also being said Northeast right of way line to the point of beginning. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin, California, held on the 19th day of February, 1968.
