~ AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA,
AMENDING THE ZONING ~ORDINANCE, NO. 157, AS
5 AMENDED, AND THE TUSTIN CITY CODE, RELATIVE TO
CIRCUSES, CARNIVALS, FAIRS AND OTHER AMUSEMENTS

~"15 The City Council of ~he City of Tustin, California, does
=I 6 hereby ordain as follows:
7 Section l: That the Zoning Ordinance of the City of
8 Tuetin, Ordinance No. 157, ae mended, is hereby amended by amend-
9 merit of subsection (b) of Section 5.3, to read as follows:
l0 "(b) Establishments or enterprises involving large
1l assemblages of people or automobiles. as follows:
1i Amusement parks and race tracks~
:. 12 2 Recreational facilities Privately'operated..
13 ~ection .2: Chapter 2 of the Tustin City Code is h~reby
14 amended by the addition thereto of Section 2-82, to read as follows:
15 "2-82 ~PPlications an~dFeeS
16 . "Application for any permit Provided by this-Chapter shall
/ be on forms provided by the City, together with a fee of
~'~ 17 -/ $25.00 to cover the cost of processing and investigation.
The APplication shall be signed by the applicant a~d veri-
- 18 lied and shall contain such information as may be deemed
necessary by the Board. Provided. however, that no appli-
19 cation fee shall 'be required of any applicant for any
activity in which it alone Proposes to engage, when such
~0 applicant is an institution or organization which is con-
ducted, managed and carried on wholly for the benefit of
and from which no profit is derived for the benefit of any
!,~, ~2 individual. Provided, further, however that when
, any
· applicant, or applicants, ~ointly, propose to carry on an
,!.~;.~3 enterprise which is to be partially for the benefit of
!'~!' 24 charitable, religious. eleemosynary and/or benevolent pur-
,i!/ poses and from which,no profit is derived for the benefit
:!j':~ ~5 of any individual, and partially otherwise, in such event
the application fee shall be the same Proportion of $25.00
as the proportion of profit bears to the proportion of non-
profit division of the Proceeds of such enterprise. In all-
applications of 'a wholly or Partiallyfee-exempt type, it
shall be the burden and responsib~lU~y:.~:.of the applicant to
set forth its basis for applicati0~f~e'~.exemption..
"' 29 Section 3: Chapter 8 of the Tustin City Code is hereby

? 1 b) Section 8-21 of ~-. Tustin City Code is hereby
amended to read a~ ~llows:
"8-21 A_p21ication for Permit
Applications for entertainment permits shall be
4 filed with the License and Permit Board on form~
· supplied by the City." --
c) Chapter 8 of the Tustin City Code is here~ amendef
~ by the addition thereto of Secti'on 8-28, to read
as follows:
"8-28 Carnivals, Circuses, Fairs and Other
Amusements.
9 No person shall establish, set up, maintain,
exhibit, participate in, conduct, or carry on, in
10 the City of Tustin, any boxing or wrestling exhibi~ic
carnival, circus, fair, ferris wheel, marathon, zoo,
11 menagerie, merry-go-round, rodeo, trained animal
shoW, wild animal show, traveling"show, wild west
~ show, parade, street dance, or any other similar
or related type of amusement, place or activity~
1~ with or without a charge being. made therefor,
except in accordance with a Permit to do so i8s. ued
14 by the License and Permit Board."
15 Section 4: There-is hereby added to Chapter 15 of the
16 Tustin City Code, Section 15-16, to read as follows:
:! 1~ "15-16 Outdoor Sales.
-~. 18 No person shall establish, maintain, participate in,
carry on or permit any outdoor sale or exchange of
.... rummage sales, white elephant sales and swap'meeta,
20 without first having obtained a Permit therefor from
the License and Permit Board."
