AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORINIA,
AMENDING ORDINANCE NO. 157, ZONING ORDINANCE, AS
AMENDED, RELATIVE TO FENCES, HEDGES AND WALLS
The City,Council'of the City of Tustin, California,
does ordain as follows: __
Section 1: Section 5.11 of OrdinanceNo- 157, as
amended, is hereby amended to read as follows:
Section 5.11 (A) Fences, hedges and walls may be
.erected in ~ny district, subject to the following
conditions:
(1) Fences, hedges and walls shall not exceed six
feet eight inches (6'8") in height on or within
all rear and side property lines on interior lot
lines, and on or to the rear of all front yard
setback lines.
(2) No fence, hedge or wall over three (3) feet in
height shall be erected in the required front
yard setback.
(3) No fence, hedge or wall over three (3) feet in .height shall be cQnstructed in:
(a) any required rear or side yard within twenty
(20) feet of the intersection of street or
alley Tights-of'way, -
(b)any require~ rear yard abutting the front yard
of an adjoining lot, or
(c) within ten (10) feet of a driveway in a required
side or .rear yard
unless approved, in writing, by the Planning Department-
(4) Fences or structures exceeding six feet eight inches
(6'8") in height to enclose areas on the rear half of
a lot may be erected subject to obtaining a Use Permit
therefor-
(5) The provisions of this section shall~not apply to a
fence or wall required by any law or regulation of
the State of California, or any agency thereof or
by any .other ordinance of the City of Tustin, for
reasons of public safety.
(B) Walls shall be constructed and. maintained on zone boundary
lines as follows:
(i) Where any "C", "M", or "Pr" zone abuts upon any
residential zone, there shall be constructed a solid
masonry wall, six feet eight inches (6'8") in height
on the zone boundary line.
(2) Where any "R-3", "R-4", or "PD" zone abuts
upon any R-1 zone, there shall be constructed a
solid masonry wall six feet eight inches (6'8")
in height on the zone boundary line.
(3) Where any "M" zone abuts upon any "C" or "Pr"
zone, there shall be constructed a solid masonry
wall six feet eight inches (6'8") in height on
the zone boundary line.
(4) The aforesaid walls shall be six feet eigh~
inches (6'8") in height except that portion of
equal depth of the front yard on the abutting
"R" classified property which shall be three (3)
feet in height unless a greater height is approved
in writing by the Planning Department.
(C) Provided, however, that upon application and proceedings
pursuant to Sections 7.2, 7.21 and 7.22, the Planning
Commission may waive or modify the requirements set
forth herein.
(~) The fences, hedges and walls provided herein shall be
measured and constructed pursuant to development
standards of the Building Department.
Section 2: Section 11.'52 is hereby amended to read as
follows:
"11.520 'YARD-FRONT' A yard extending across the full
width of the lot, the depth of which is measured'from
the front line of th~ lot to the nearest line of the
building; provided, however, that if any Official Plan
Line has been established for the street upon which the
lot faces, the front yard measurement shall be taken
from such Official Plan Line to the nearest line of ~he
building."
Section 3: Section 11.54 is hereby amended to read as
follows:
"11.540 'YARD-SIDE' A yard between the side line of the
lot and the nearest line of the building and extending
from the front yard to the rear yard."
Section 4:.Section 11.91 is hereby added as follows:
"11.91 'BUILDING SETBACK LINE' A line established to
denote the minimum distance a building may be constructed
from a property line or a right-of-way line."
Section 5:'Section 11,321 is hereby added as follows:
"11.321 'OFFICIAL PLAN LINE' A line established ~to denote
the ultimate right-of-way of a street."
