HomeMy WebLinkAboutORD 343 (1967) ORDINANCE NO. 343 AN ORDINANCE 0F THE CITY COUNCIL OF THE CITY 1 OF TUSTIN, CALIFORNIA, APPROVING THE ANNEXATION OF CERTAIN UNIINHABITED TERRITORY, DESIGNATED 2 "RED HILL-WALNUT ANNEXATION" TO THE CITY OF TUSTIN, CALIFORNIA. 8 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TUSTiN 4 ~rHEREAS, on the 20th day of February, 1967, the Council ~ of the City of Tustin did pass and adopt Resolution No. 863'~~ · 8 giving notice of the proposal' to annex certain uninhabited territo ~ to the City of Tustin, said territory being therein designated as 8 "Red Hill-Walnut Annexation", said Resolution describing the 9 boundaries of the territory proposed to be annexed; and ~0 WHEREAS, said Resolution contained a notice of the day, -11 hour and place when and where the Council of the City of Tustin _IZ would hear protests made by any person owning real property within -13 the territory proposed to be annexed, the time of said hearing 14 being as prescribed *by Law, and WHEREAS, on the 6th day of March, 1967 at the hour of ~8 7:30 o'clock, P M., in the Tustin Area Youth Center, in the ~ City of Tustin, County of Orange, State of California, said time ~8 and place being the day, hour and place fixed in said Resolution -19 for hearing protests to the said annexation, the said City Council Z0 did hear and pass upon all protests made to the proposed annex- 21 ation and did determine that protests hadcnOt b~en' made~b~ 22 owners of one-half of the value of the privately owned territory 9.$ ~roposed to be annexed, as shown by the last equalized assessment 24 ~o~i, nor by public owners of one-half of the value of the publicly 9.~ ~wned territory proposed to be annexed as determined by said 9'6 -egislative body; and 27 WHEREAS, said territory is contiguous to the City of Z$ 7ustin, and is uninhabited territory in the County of 0ra.~nge; 29 NOW, THEREFORE, The said Council of the City of Tustin ~0 Loes hereby approve the annexation of the territory hereinafte.r 81 ~-escribed to the City of Tustin, and does hereby 'further ordain 82 hat the said territory be and it is hereby annexed to the City of ustin. That said territory, the annexation of which to the City of Tustin is hereby approved, is all the territory situate Ln ~h~ County of Orange, State of California, more oarticularly described as follows: - .That portion of Blocks 1i and 45 of Irvine's Subdivision in the County of Orange, State of California, as per map recorded Ln Book l, page 88 of Miscellaneous Record Maps in the office of the County Recorder of said Orange County, described as follows~ Beginning at an angle point in the boundary of the Warner - Sycamore Annexation to the City'of Tustin as established per City of Tustin Ordi- nance Nee 245 and certified by the Secretary of the State of California, january 7, 1964, said angle ooint being also the intersection of the Southeasterly line of Lot 63,. said Block 11 with the Northeasterly right of way line of the Atchison, Topeka and Santa Fe Railway Company right of way, 100.00 feet Wide; thence North 40° 02' 59" East 1270.33 feet along said Warher - Sycamore Annexation boundary being also said Southeasterly line of Lot 63 to an angle point therein, said-~gle point being also the most Easterly corner of said Lot 63; thence leaving said Warner - Sycamore Annexation boundary North 40o 02' 59" East 1320 feet, more or less, along the Northwesterly line of Lot 51, said Block 11 to the most Northerly corner of said Lot 51; thence South 50° 00' 0O" East 3300 feet, more or less, ~iong the Northeasterly line of said Lot 51 and the Northeasterly line of Lot 52, said Block !1 and Lot 53, said Block 45 to the Northwesterly right of way line of that certain Atchi'son, Topeka and Santa Fe Railway .Company easement, 60.00 feet wide, as described in the deed recorded August 29, 1914 in Book 258, page 383 of Deeds, records of said Orange County; thence South 39° 53' 00" West 1880 feet, more or less, along said Northwesterly right of way line to the beginning of a tangent curve therein, concave Easterly having a radi~us " of 794.49 feet; thence SoUtherly 890.92' feet along said curve being also the Westerly right of w~y line of said easement through an angle of 64° 15' 00" to said Northeasterly right of way line of the Atchison, Topeka and Santa Fe Railway Company right of way, 100.00 feet wide; thence North 50° 10~,~ 50" West 3749 feet, more or less, along said Northeasterly right of way line to the point of beginning.
