HomeMy WebLinkAboutORD 335 (1967) ORDINANCE NO. 335 2 AN ORDINANCE 0F THE CITY OF TUSTIN CALIFORNIA AMENDING THE ZONING ORDINANCE TO PR0VIDE FOR A 3 P-C PLANNED COMMUNITY DISTRICT. ~ The City Council of ~he City. of Tustin does ordain as 5 follows: 8 l) The City Council finds and determines: V a) That amendment proceedings were duly initiated for amendment of the Zoning. Ordinance of the City 8 of Tustin; 9 b) The Pi~lning Commission~ after public hearing du!~ caiied~ noticed and held, recommended adoption of i0 said amendment; il c) That the City Council regularly called, noticed and held a public hearing on said proposed amend-' 12 ~ ment; 13 d) That said amendment should be adopted. l~ 2)~. The Zoning Ordinance of the City of Tustin, Ordinance 15 No. 157, as ~aended, is here'by amended by the addition thereto of ~6 the following: 1V Section 4.16 P-C Planned Commmnity District 18 4.161 Purpose 19 To allow diversification of the relationships of various 'buildings, 20 structures and open spaces in planned building groups while insur- ing substantial compliance with the district regulations and other 21 provisions of this ordinance, in order ~hat the intent of this ordinance that adequate standards related to the public health, 22 safet'y and general welfare shall be observed without unduly inhi'bit ing the advantage of large scale planning for residential, commer. 23 cial and industrial purposes. The amenities and compatibilities of P-C Districts are to be insured through the adoption of a Develc - 2~ merit Plan and/or the approval of Use Permits, maps, diagrams, and text setting forth land use relationships and development standards 25 4.162 General Requirements 26 The following provisions shall apply in the P-C District, which 27 district shall 'also be subject to the other provisions of this ordinance, except that where conflict in regulations occur, the 28 regulations specified in the section or in the Development Plan or plans approved pursuant to this section shall apply. 29 (A) Application 30 The entire parcel for which an application for rezoning 31 or prezoning to P-C i:-~ filed must be in one ovmership, or the application :I. ~, be made by or With the written 32 authoriz~¥~:~.c.n for .'-, j- .,~sion on behalf of all property -., '. . ,m2m ! owners concerned, and the applicant, together with a statement signed by interested owners that they agree ~-- 2 to be bound by the regulations s~d conditions which will 3 'be effective.within the district. 4 (B) Uses Permitted · 5 (1) The uses Permitted in any P.C. District shall be those designated on the approved Development Plan 6 Provided that in the event that such approved usage does not conform to the General Plan of the City, 7 the General Pl~n shall be amended to confirm to the Development Plan simultaneous with the amending of th~ 8 Zoning Ordinance classifying the area P-C. 9 (2) The continued use of land within a P-C District for agricultural Purposes 'shall be Permitted. 10 (3) Grading shall be Permitted within a P-C District out~ 11 side of an area of irmmediate development subject to the securing of a grading permit. 12 (4) Any area designated for residential use may be !3 developed at a lower residential density than is indicated on the approved Develonment Plan ~ithout 14 requiring an amendment of .the De~e!opment Plan. 15 4.163 Procedures !6 (A) ~Y aPPlication for a zone change to permit the !7 esta'b!ishment of a P-C District shall be made pursuant to Section 9.0 of this ordinance and shall be accom- 18 panied by a Development Plan for the entire Parcel-~ic~ is the subject of the aPPlication. 19 (B) Areas on the Development Plan shall be subject to one 20 of the following or any combination thereof: ~! (1) The requirements of any of the Zoning'districts established.by this Ordinance, as amended~ 22 (2) Standards of development set forth on the approved ~3 Development Plan and supplementary text material; 2~ (3)" Approval of a Use Permit 'by the Planning Commission prior to development. · 25 (C) The Development Plan shall set'forth the following: 27 (1) The proposed use of all lands within the subject property and the approximate dimensions of the 28 exterior boundaries of each area; if-- - 29 (2) The type, character and heights of buildings or structures and the number of dwelling units per 30 .... gross acre proposed for each residential area; 31 (3) The location of school sites; recreational facilities and other public and Quasi-public facilities and 32 the approximate area of each site; 122 - (4) The general location of major thoroughfares coordinated with the Orange County Master Plan of Arterial Highways; (5) A topographic map of the property; (6) A preliminary report describing proposed provisions for storm drainage; sewage disposal, water supply, and other-utilities; (7) A justification of all commercial and industrial facilities~ if any, to be located within the subject property-' The Development Plans after its approval and adoption as provided herein, shall be recorded in the office of the County Recorder and all development within the district shall substantially comply therewith, except as said Development Plan may be amended by ordinance. Commencement of Construction Building construction shall not be commenced unless and until one of the following alternatives has been accomplished: (i) There has been recorded a final subdivision map for any specific portion of the district designated on the Development Plan as subject to the regulations of a zoning district established by this ordinanc~ or for which Standards of Development have been approved. Said subdivision shall comply with the ....................... uprovisions of Ordinance No. 85, as amended, and the State Subdivision Map Act. (2) Standards of development have been approved on the Development Plan for the specific area proposed for development. If ambiguity exists as to the SpeCifiC dimensions or extent of'any designated a~ea on the Development Plan; the specific boundaries shall be set by the filing of a legal description and map of the parcel proposed for development in conjunction with'the filing for construction permits. (3) The Planning Commission has granted a Use Permit. .for any specific development. (F) Application for a Use Permit for development as stipulated above shall include the following as applicable: (1) Topographic mad of the property showing the proposed method of adapting the development to the site; (2) Legal description or boundary survey of the property; ........ (3) Location, grades, widths and types of improvements proposed for. all utilities, streets, walkways, driveways and service areas; ! (4) Location, height number of stories and number oj ~ residential units, if any, for each proposed struc~ure~ "'" 5 (5) Location and design'of automobile pa~king areas; ~ (6) Preliminary landscaping plan; 5 (7) Location of public or quasi-public buildings or 6 areas, including, but not limited to, schools, recreation faciiities, parking areas, and service 7 areas, if any; 8 .... (.8) Elevations of structures showing architectural type;.
