HomeMy WebLinkAboutORD 283 (1965) [ ORDINANCE NO. 283 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE TO REQUIRE PARKWAY TREES. The City Council of the City of Tustin, California, does ordain as follows: 1) The Tustin City Code is hereby amended by the addition of Section 18-28, to read as follows= Section 18-28: Trees and Landscaoe. (a) Trees of the types set forth in the List of Approved Trees, as now provided in Chapter 23 of this Code, and as may be amended hereafter, shall be planted in the manner set forth in the Planting Specifications, as now provided in Chapter 23 of this code, and as may be amended hereafter, and in accordance with the Master Tree Plan, as now provided in Chapter 23 of this Code and as may be hereafter amended. (b) Prior to approval by the City Council of the final map, subdivider shall execute and file an agreement between subdivider and the City, and post a bond of cash, as provided by Section 18-27, to guarantee the completion of said improvements, together with an amount to cover the cost of maintenance of said trees for a period of one year. Said amount is to be determined by City, as sufficient to cover said costs. (c) In lieu of planting trees and landscaping by subdivider, and executing and filing an a~reement together with with~ City ~0.125 per ~inea! foot a bond, subdivider may deposit ~ of property boundaries abutting public streets, measured at the curb line, as a fee for the planting of oarkwsy trees by the City. City shall be resoonsible for the installation of parkway trees in the location, manner and type specified herein. In addition., subdivider shall pay to City an amount.to cover the cost of maintenance of said trees for a period of one year. Said amount is to be determined by City as sufficient to cover said costs. 2) Chapter 23 of the Tustin City Code is hereby amended. to read as follows:: Section 23-1r Purpose of this Chapter. This chapter is intlended to give full power, authority and jurisdiction tothe City of Tustin over all trees, plants or shrubs planted in or ~rowin~ upon any of the ~ubiic streets or highways of or in the City. Section 23-2: Damage It shall be unlawful for any person to fasten any animal, guy-rope, guy-line, or any other contrivance to any tree or shrub or to any stake, guard or other protective structure located in the public streets, highways or alleys, or upon City-owned property, or in any manner, from which danger or injury may result to such trees, plants or shrubs. Section 23-3:: Destruction It shall be unlawful for any person to cut down, girdle, remove, injure, deface or destroy any standing or growing tree or or any ornament or improvement on any public street, highway, alley or sidewalk within the City, without first obtaining written consent therefor from the Street Commissioner of the City of Tustin. Section 2}-4: Maintenance Except as otherwise provided herein, it shall be the duty and responsibility of every person to water and otherwise maintain in proper and sightly manner, any and all trees and shrubbery located in the dedicated right-of-way, street, highway, alley or sidewalks located. in front of property owned by said persons. Section 2~-5: Permit to Trim No person shall cut, break or trim any tree or plant in any dedicated right-of-way, street, highway, alley or sidewalk, without first obtaining from the Street Commissioner a written oermit therefor. Section 25-6: Trimming of Limbs. When the Street Commissioner determines that any limbs or branches or other growth on any trees or shrubbery growing on any land owned by the City or located in dedicated rights- of-way, the Street Commissioner may cause such trimming to be done, or by direction of the City Council may cause directions to be given to bhe property owner in front of whose property said trees or shrubbery are located, to perform such trimming. Section 2~-?: R.equirements of P!~nting Whenever any person shall apply for a building permit for the construction, reconstruction, remodeling or addition of any structure, with a cost of construction, reconstruction, remodeling or addition exceeding fifty percent (50%~' of the then assessed value of the then existing improvements upon the property, said plans of improvement shall show and provide for planting of trees in accordance with the Master Tree Plan, as now provided in Section 23-9 hereof, and as may be amended hereafter, to be planted in the manner set forth in the Planting Specifications, as now provided in Section 23-8 hereof, and as may be amended hereafter. Section 25-8: Planting Specifications. The Planting Specifications for the planting 5f all trees are set forth as follows: 1. All planting wells shall be prepared 24" deep, with the following soil conditioners mixed through the entire depth of backfill in the proportion of 50% soil and ~0% conditioners. Each cubic yard of conditioner shall be mixed. in the following proportion:~ Soil ~0% Peat Moss ~0% Steer Manure 10% 2. Finished Grading After the tree wells have been backfilled, and the soil has been watered and settled, the area is ready for planting. Immediately after planting, all trees shall be staked with 2" x 2" x 8' redwood stakes. Stakes shall be placed away from the ball of the tree as shown i.n the diagram, and shall be on the wind~ar~ side, so!that the tree trunk will blow away from the stake. 1241 Staked trees shall be fastened with two hose-and-wire ties, placed ss indicated in the drawings. Use No. I0 galvanized wire and new fabric hose collars, black, brown or green in collor. Turn the ends of the wire inward., so sharp ends are on the outside of the stake. 4o Trees shall not be less than five (5) gallons in size. 5. All areas lying on the street side of shy fence'or wall ~ Iocated on or adjacent to the rear property line of any ' property whose rear property line is adjacent to a public street or highway, shall be completely paved between the said wall or fence and the curb line, except for planter openings as shown hereafter. 6. All trees shall be planted at the intervals specified in the Master Tree Plan, as now provided in Chaoter 23 of this Code, and as may be amended. hereafter. 7.
