HomeMy WebLinkAboutORD 279 (1965)1230 ORDINANCE NO. 279 AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "RICHARD B. SMITH ANNEXATION" TO THE CITY OF TUSTIN, CALIFORNIA. BE IT 0RDAINED BY THE .COUNCIL OF THE CITY OF TUSTIN: WHEREAS, 0n the 18th day of January, 1965, the Council of the City of Tustin did pass and adopt Resolution N~o. 765 giving notice of the proposal to annex certain uninhabited territory to the City of Tustin, said territory being therein designated as "RICHARD B. SMITH ANNEXATION", said Resolution de'scribing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution contained a not'ice of the day, hour and place when and where the Council of the City of Tustin would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being not less than forty nor more than sixty days from the date of passage of said Resolution; and WHEREAS, on'the 15th day of March, 1965, at the hour of 7:30 o'clock, P.M., in the Tustin Youth Center, in the City of Tustin, County of Orange, State of California, said time and place being the day, hour and place fixed in said Resolution for hearing protests to the said anne×stion, the said City Council did hear and pass upon all protests made to the proposed annexation, and did determine that protests had not been made by the owners of one-half of the value of the privately owned territory proposed to be annexed ss determined by said legislative body; and WHEREAS, said territory is contiguous to the City of Tustin, and is uninhabited territory in the County of Orange; NOW, THEREFORE, the said Council of the City of Tustin ~"~ does hereby approve the annexation of t'he territory herein- after described to the City of Tustin, and does hereby further ordain that the said territory be and it ishereby annexed to the City of Tustin. That said territory, the annexation of which to the City of Tustin is hereby approved, is all that territory situate in the County of Orange, State of California, more particularly described ss follows: 1231 Commencing at a point on existing City boundary of the City of Tustin, as per Yorba Street Annexation described in Ordinance No. 135, said point being the southeast corner of Lot 1 of the Felipe Yorba Tract as shown on a map thereof recorded in Book 4, page 206, Miscellaneous Records of Los Angeles County, California; thence departing from said Tustin City boundary, N 890 22' 45" W along the South line of said Lot 1, a distance of 390 feet, more or less, to an angle point in the existinn city boundary of the City of Santa Ana as per Tustin and Fourth East Annex described in Ordinance No. NS-379; thence following slon~ said Santa Ana City boundary N 6° 21' 22" E, a distance bf 175-67 feet, to an angle point; thence continuing along said Santa Ana City boundary N 4© 55' 27" E, a distance of 580.04 feet, to the Nort~h line of said Lot l; thence continuing along said Santa Ana City boundary S 89° 22' 45" E along said North line, a distance of 330 feet, more or less, to the Northeast corner of said~Lot l, said corner being an angle point in said Santa Ans City boundary and also being a point on the existing city'boundary of Tustin ss per said Ordinance No. 135; thence departing from said Santa Ans City boundary and following along said TustinCity boundary, S 0oll' 30" E~along the East line of said Lot l, a distance o:f 752.9 feet, to the point of beginning.
