HomeMy WebLinkAboutORD 274 (1965) ORDINANCE N0.274 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, CHANGING ZONE OF PROPERTYON APPLICATION NO. Z.C. 64-140 OF TUSTIN ELEMENTARY SCHOOL DISTRICT. The City of Tustin, CaLifornia, ordains as follows: Section 1: The City Council finds and determines that on behalf of Tustin Elementary SChool District for zone change from E-4 to PR zone of property described as follows~~ PARCEL A , That portion of land in the County of Orange, State of California, described as follows: Commencing at a point on the centerllne of Prospect Avenue distant northerly 784-39 feet from the south- east corner of the first tract allotted to Teodocia Yorba by decree in the partition of the Rancho Santiago de Santa Ana, in the suit of Abel Stearns, el.al., v.s. Leonardo Cota et.al., said southeast corner being marked by a Bolt at the centerline intersection of prospect Avenue and First Street; thence S 89° 3?' 54" W 1219.96 feet to a point in the west line of Said tract allotted to Teodocia Yorba distant along said westerly line N 0o 10' 30" W 781.34 feet from the southwest corner of said tract, said point being the TRUE POINT OF BEGINNING of the parcel of land to be described herein; thence along said west line N 0° 10' 30" W 112.75 feet to a point on the southerly line of the parcel of land described in an easement deed to the County of Orange ~ecorded August 9, 1962, in Book 620? page 885 of Official Records in the office of the County Recorder of Orange County California, said southerly line being a nontangent curve conc~e southerly and having a radius of 1150.00 feet, (a radial llne of said curve thru said poSnt bears N 6° 17' 39" W); thence easterly 118.04 feet along said curve thru a central angle of 5° 52' 52" to a tangent line; thence N 39° 35' 13" E 62.19 feet to a line that is parallel with and 180.00 feet easterly of said westerly line of tract allotted to Teodocia Yorba; thence along said parallel line S 0© 10' 30" E to the line above designated as "S 89° 37' 54" W 1219.96 feet";~ thence along said line S 89° 37' 54" W 180.00 feet to the TRUE POINT OF BEGINNING. Leonardo Cota, et.al., said southeast corner being marked by a Bolt at the centerline intersection of Prospect Avenue and First Street; thence S 89° D?' 54" W 1219.96 feet to a point on the westerly line of said tract alloted to Teodocia Yorba distant along said westerly line N 0© 10' 30" W 781.34 feet from the southwest corner of said tract, thence along said westerly line N 0© 10' 30" W 212.75 feet to the TRUE POINT OF BEGINNING of the parcel of land to 1214 be described herein, said TRUE POINT OF BEGINNING being on the most northerly line of s parcel of land conveyed to the County of Orange recorded August 9, 1962, in Book 6207, page 885, of Official Records in the office of said County Recorder; thence. continuing along said westerly line N 0o 10' 30" W 105.93 feet to the Northeast corner of Tract No. 5311 as shown on a map recorded in Book 200, page 4 and 5 of Miscellaneous Maps in the office of the County Recorder of said County; thence along the easterly prolongation of the northerly line of said tract N 89© 47' 09" E 150.00 feet; thence parallel to said westerly line S 0° 10' 30" E 99.89 feet to said most northerly line of s parcel of land conveyed to the County of Orange; thence along said northerly line S 89° 35' 13" W 62.39 feet to the beginning of a tangent curve concave southerly and having a radius of 1250.00 feet; thence westerly along said curve 117.60 feet thru s central angle of 5° 23' 25" to the TRUE PQINT OF BEGINNING. EXCEPTING THEREFROM: that portion described ss follows: Beginning. at the intersection of said. northerly line of parcel of land conveyed to the County of Orange with the easterly line oflthe above described parcel; thence northerly along said easterly line 20.00 feet; thence southwesterly in a direct line to a point on said northerly line of parcel conveyed to the County of Orange distant westerly 20.00 feet from the point of beginning, thence easterly 20.00 feet to the point of beginning. (b) That the Planning Commission duly called, noticed and held a public hearing on said application and recommended said zone change to the City Council. (c) That the City Council duly called, noticed and held a public hearing on said proposed zone change. (d) That said proposed zone change would be in the best ~nterests of the subject property and adjacent areas and uses and in harmony with the general plan of the City of Tustin, and should be granted. Section 2: The herein described property is hereby changed from the E-4 zone to the PR zone, and the Zoning Ordinance of the City oflTustin amended accordingly and the zoning map of the City of Tustin accordingly amended.
