HomeMy WebLinkAboutORD 229 (1963) ORDINANCE NO. 229 AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED AS " PANKEY ANNEXATION NO. 2" TO THE CITY OF TUSTIN, CALIFORNIA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TUSTIN: WHEREAS, on June 3rd, 1963, the 'Council of the City of Tustin did pass and adopt Resolution No. 660, declaring [hat proceedings had been initiated by the City Council of' the City of Tustin, California, to annex to said City certain un- inhabited territory described t'herein and designated as "PANKEY ANNEXATION N0.2" and givin~g notice of the proposed annexation, and said Resolution described the boundaries of the territory .proposed to be annexed; and WHEREAS, said Resolution did contain a notice of the day, hour and place when and where the Council of the City of Tustin would hear protests made by any person owning real pro~ petty within the territory proposed to be annexed, the time of ;_Said hearing being not less than forty (40) nor more than sixty (60) days from the date of passage of said Resolution; and WHEREAS, the Boundary!L~Commission of the County of Orange, State of California, did, in session duly assembled, approve the proposed annexation boundaries of said annexation; and WHEREAS, 0.n July: 15, 19163, at the hour of 7:30 P.M. in the Council Cham~ers, in the City Hall, 145 West Third Street, City of Tustin, County of Orange, State of. California, said time and place being° the day, hour and place fixed in said Resolution for hearing pro.~ests to the said annexation~,the City Council did heariand pass upon all protests made to the proposed annexation, and did determine that protests had not been made by the owners of one-half of the value of the pri- vately owned territory proposed to be annexed, as shown on the last equali~zed assessment roll, not by public owners of one-half of the value of the publicly owned territory porposed to be annexed, as det~mined by said legislative body, and WHEREAS, said territory is contiguous to the City of o83 Tustin, and is uninhabited territory in the County of Orange, NOW, THEREFORE, Ithe City Council of the City of Tustin does hereby approve the annexation of the territory hereinafter described to the City of Tustin, a. nd does hereby further or- dain that the said territory be, and the same hereby is annexed to the City of Tustin. That said. territory, the annexation of which the City of Tustin has herein approved, is all that territory sit- uated in the County of Orange, State of California, more par- ticularly described as follows: LEGAL DESCRIPTION FOR PANKEY ANNEXATION NO. 2 TO THE CIT~ OF TUSTIN Beginning at the intersection of the Southeasterly line of the Northwesterly one-quart~e~ of Lot 31, Block 12, of Irvine's Subdivision as shown on.~!a map thereof recorded in Book l, Page 88, Miscellaneous 'Maps, Records of Orange County, California, with the Southwesterly line of the NOrtheasterly one-half of said Lot 31, ~said inters~otion being on the boundary line of the High School Annexation to the City of Tustin adopted in a - ¢colrdance with a Resolution by the Orange County Board of Super- visors, dated June 19, 1957, said intersection also being an angle point in the b~undary line of High School Annexation No. 2 adopted in accordance with a~ Resolution by the Orange Coun- ty Board of Supervisors dated January 22, 1958; Thence, following along the boundary line of said High. SchoOl Annexation No.2 So 49°21'04" E., along the Southwest- erly line of the Northeasterly one-half~of said Lot 31, a dis- tance of 661.40 feet, more or less, to the most Southerly cor- ner of said High School Annexation NO.2, said corner also being the most~Westerly corner of the First'Southern Baptist Church of Tustin Annexation to the City of Tustin in accordance with Ordinance No. 169 passed and adopted by the Thstin City Coun- cilon Februar~ 19, 1962; Thence,~following along the Southwesterly line of . 4 °21 said First Southern Baptist Church Annexation S 9 '04" E. along the Southwest line of the Northeast one-half of said Lot 1084 31, a distance of 280.72 feet'to the intersection of a line parallel to and 50 feet Northwesterly of as measured at right angles to the surveyed centerline of Red Hill Avenue; Thence, S.40°40'06'' W. along said parallel line, a distance of 271.88 feet, to the existing boundary line of Pankey Annexation to the City of Tustin in accordance with Ordinance No. 99, passed and adopted by the Tustin City Coun- cil on May 23, 1956, said boundary line being on a curve, concave Southwesterly, and having a radius of 528 feet; Thence, following along ~he boundary line of said Pankey Annexation, Northwesterly along said curve through a central angle of 28° 23' 47" an arc distance of 261 68 feet to a line tangent at the end of said curve; Thence, following along ~he boundary line of said :Pankey Annexation N. 78° 15' 12" W, a distance of 173.83 feet to the beginning of a tangent curve concave Northeasterly and having a radius of 772 feet; Thence, following along the boundary line of said Pnakey Annexation Northwesterly along said corve through a central angle of 17° 00' 00" an!arc distance of 229 06 feet to a line tangent at the end of said curve; Thence, following along the boundary line of said 6° Pankey Annexation N i 15' 12" W, a distance of 331.86 f~t to the intersection of the Southeasterly line of the North- westerly one-quarter of said Lot 31, said Southeasterly line also being on the boundary line of said High School Annex- ation; Thence, following along the boundary line of said High School Annexation,N 40° 38' 03" E along said Southeast- erly line, a distance of 569-79 feet to the point of beginning. PASSED AND ADOPTED by the City Council of the City of Tustin at a regular meeting thereof, held on the 5th day of August, 1963.
