HomeMy WebLinkAboutORD 217 (1963) ORDINANCE NO. 217 AN ORDINANCE OF THE CITY OF TUSTIN, APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED AS "BRYAN AVENUE ANNEXATION" TO THE CITY OF TUSTIN, CALIFORNIA. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TUSTIN: WHEREAS, on March 18, 1963, the Council of the City of Tustin did pass and adopt Resolution No. 648, declaring that proceedings had been initiated by the City Council of the City of T~stin, California, to annex to said City certain unin- habited territory described therein and designated as "BRYAN AVENUE A ANNE.~TION" and giving notice of the proposed annexation, and said Resolution described the boundaries of the territory proposed to be annexed; and WI~EREAS, said Resolution did contain a notice of the day, hour and place when and where the Council of the City of Tustin would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being not less than forty (40) nor more than sixty (60) days from the date of passage of said Resolution; and WHEREAS, the Boundary Connnission of the County of Orange, State of California, did, in session duly assembled, approve the proposed annexation boundaries of said annexation; and WEEAS, on May 6, 1963, at the hour of 7:30 P.M., in the Council Chambers in the City Hall, 145 West Third Street, City of Tustin, County of Orange, State of California, said time and place being the day, hbur and place fixed in said Resolution for hearing protests to the said annexation, the City Council did hear and pass upon all protests made to the proposed annexation, and did determine that ~'~ protests had not been made by the owners of one-half of the value of the privately owned territory proposed to be annexed, as shown on the last equalized assessment roll, or by public owners of one-half of the value of the publicly owned territory proposed to be annexed, as determined by said legislative body; and WHEREAS, said territory is contiguous to the City of Tastin, and is uninhabited ~erritory in the County of Orange; NOW, THEEFOE, the City Council of the City of Tustin does hereby approve the annexation of the territory hereinafter described to the City of Tustin, and does here~by further ordain that the said territory be, and the same hereby is annexed to the City of T~stin. lo55 That said territory, the annexation of which the City of Tustin has herein approved, is all that territory situated in the County of Orange, State of CaliforHia, more p~rticularly described as follows: Beginning at a point on the existing boundary line of the Bryan-RedHill Annexation to the City of Tustin as per Ordinance No. 172 passed and adopted by the Tustin City Council on June 4, 1962, said point being on a line parallel to and 40 feet Southwesterly of as measured at right angles to the surveyed centerline of Bryan Avenue, said point also being on the Southwesterly prolongation of the Southeasterly line of Tract No. 1737, as shown on a map thereof recorded in Book 49, Page 43 of Miscellaneous Maps, Records of Orange CoUnty, California; Thence, leaving sain Bryan-Red Hill Annexation boundary line N. 39o54'37'' E. along said Southwesterly prolongation and along said Southeasterly line of said Tract Nof~ 1737 and along the Northeasterly prolongation thereof, a distance of i,360.98 feet, to a point on the Southwesterly line of Tract No, 3858 as shown on a map thereof recorded in Book 142, Pages 44 and 45 of Miscellaneous Maps, Records of Orange County, California; Thence S. 50°00'12'' E,m along said SouthWesterly line, a distance of 330-~8 feet to the most Southerly corner of said Tract No. 3858, said corner also being the most Westerly corner of Tract No. 2474 as sho~,m' on a map thereof recorded in Book 85, pages l, 2, and 3 of Miscellaneous Maps, Records of Orange County, California; Thence, S. 50o00'20'' E., along the Southwesterly line of said Tract No. 24?4 and the Southeasterly prolongation thereof, a distance of 682.88 feet, to a point on the Northeasterly prolongation of the Northwesterly line of Lot 42 of Tract No. 2916, as shown on a map thereof recorded in Book95, pages 8 and 9 of Miscellaneous Maps, Records of Orange County, California; , 9° ' 07" , Thence S. 3 55 W. along said Northeasterly prolongation, along said Northwesterly line of Lot 42 and along the Nort~b~esterly line of Lots 41, 40, 39, 38, 37, 36, 35, and 34 of said Tract No. 2916 a distance of 771.80 feet to the most Westerly corner of said Lot 34; Thence, S. 11°41'05'' E. along the Southwesterly line of Lots 34, 33, 32, and 31 of said Tract No. 2916 a distance of 268.85 feet to 1056 an angle poin~ in the Southwesterly line of said Lot 31, said angle point also being a point on the existing 'boundary line of said Bryan-Red Hill Annexation; Thence, following along said Bryan-Red Hill Annexation boundary the following courses and distances; N. 49°59'~~' W., a distance of 233.21 feet, to an angle point; S. 39o55'25'' W,m a distance of 422.50 feet, to an angle point; N. 49o59'47" W., a dist nce of 990.24 feet, to the point of beginning. PASSED AND ADOPTED by the City Council of the City of Tustin at a regular meeting thereof, held on the 20th day of May,1963.
