HomeMy WebLinkAboutORD 203 (1963) ORDINANCE NO. 203 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING ORDINANCES NO. 157 AND NO. 175, THE ZONING ORDINANCE OF THE CITY OF TUSTIN, PROVIDING FOR DEDICATION OF RIGHTS OF WAY. The City Council of the City of Tustin, California, does ordain as £ollows: Ordinances Nos. 157 andI175, the Zoning Ordinance of the City of T~stin, are hereby amended by the addition of the following; Section l: Ordinance No. 157, as amended b~ Ordinance no. 175, is hereby modified and amended by the addition of Section 7.23 thereto, to read as follows: Section 7.2~.. HIG~AY DEDICATION AND IMPROVEME NT. No building and no. Lland shall be used for an y of 'the commercial uses pe~aitted in the C-l, C-2, C-3 or M Zones nor shall any Certificate of Use and Occupancy therefor be issued by the Building and Safety Department, where the land u~on which such building or laH~d to be used for said uses abuts upon, and the ingress or egress to the said building or land is by way of or into or upon any existing highway or highways shown on the Master Plan of Streets and Highways, adopted by the City of Tustin on December ~, 1960, as amended, until and unless the right of way for such highway or highways to the width shown on "Standard Streets and Highways Plans" has been dedicated to or vested in the City of Tustin, and such right of way has been improved by installation of curbs, gutters, and street drainage, in full compliance with the City of T~stin Street Improvement Standards, adopted March 4th, 1963, as amended, or the owner has dedicated or irrevocably offered to dedicate such right of way and prepared plans for the improvement and has entered into an agreement with the City to Make such improvements. In the event~ an agreem&nt for the improvements is entered into TM , the City Council my require that the agreement be secured by a good and l sufficient 'bond, or it my accept in lieu thereof a cash deposit, which bond or cash deposit shall be in an amount equal to the estLmated cos t of the imorovememt. "Commercial use" as used in this Section means any retail, wholesale, or manufactu~ying business, the carrying on of any profession, the operation of mobilehome parks , hotels, or any business, but does not include farming, including all types of agriculture and horticulture, or the conducting of temporary stands for the sale of agricultural or farming products grown or produced in the premises as aeeessory use to the land, or the conducting of any home occupation. :~ASSED AND ADOPTED at a regular meeting of the ~ity ~ouncil of the City of Tustin, held on the 4th day of March, 1963- ~YOR ~ ATTEST: CITY CLEE STATE OF CALIFORNIA) COUNTY OF O~tNGE ) SS CITY OF TUSTIN ) RUTH C.
