HomeMy WebLinkAboutORD 177 (1962) ORDINANCE NO. 177 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA MODIFYING AND AMENDING THE ZONING MAP OF THE CITY OF TUSTIN BY REZONING THE PROPERTY OF CHARLES A. PATTON TO THE R_2 ZONE AND THE R-3 ZONE. The City Council of the City of Tustin, California, does ordain as follows: Section l: The City Council of the Cityof Tustin finds and determines that a proper application for rezoning was filed on behalf of CHARLES A. PATTON for rezoning of the property on the south side of McFadden Street, approximately 810 feet easterly of Tustin Avenue., and also having frontage upon Newport Boulevard, to the H-3 Zone. ~ t · Section 2: The Planning Commission of the City of Tustin, California, duly called and noticed a public hearing on the proposed zone change, on the 20th day of May, 1962, at 7:30 P.M., in the Council Chambers, in the City Hall, Tustin, California, all in accordance with Ordinance No. 157 of the City of Tustin. Said hear- ing was duly held. ~ectio. n 5: The Planning Commission recommended to the City Council that said property be rezoneA to the R-3 Zone. Section 4: The City Council'of the City of Tustin duly called and noticed a public hearing on the troposed zone change on the ilth day of June, 1962, at 7:30 P.M., in the Council Chambers of the City Hall, Tustin, California, all in accordance with Ordin- ance No. 157 of the City of Tustin. Said hearing was duly held. Sectio~.,~: The City Council of the Cityof Tustin finds and determines that said property should be rezoned to the R-3 Zone, except for Lots 11 and 12 thereof, being the frontage upon McFadden Street, which should-be rezoned to the R-2 Zone. It was stipulated and agreed with the City of Tustin, as a condition of said rezoning that the buildings constructed upon Lots 11 and!2, on the McFadden Street frontage, would be limited to one story in height. Section 6: The Zoning Map of the City of Tustin is hereby modified and amended by change to the R-3 Zone of the pro- perty described as: 889. A portion of Section 16, Township 5 South, Range 9 West, San Bernardino Base and Meridian, in the Rancho Santiago de Santa Ana, a portion of F. W. Koll Allotment, County of Orange, State of California, as set forth in the attached Map, except for Lots ll and 12 thereof, which are rezoned to the R-3 Zone. The building lines are hereby established as shown on said Map, which is attached hereto and made a part hereof as though fully set forth hereat.
