HomeMy WebLinkAboutORD 169 (1962)846 ORDINANCE NO. 169 AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED AS " FIRST SOUTHERN BAPTIST CHURCH OF TUSTIN ANNEXATION TO THE CITY OF TUSTIN, CALIFORNIA BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TUSTIN: WHEREAS, on December 18, !~61, the Council of the City of Tustin did pass and adopt Resolution No. declaring that proceedings had been initiated by the City Council of the City of Tustin, California, to annex to said City certain uninhabited territory described therein and designated as ~FIRST SOUTHERN BAPTIST CHURCH OF TUSTIN ANNEXATION~ and giving notice of the proposed annexation, and said Resolution described the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution No. 577 did contain a notice of the day, hour and place when and where the Council of the City of Tustin would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being not less than forty (40) nor more than sixty (60) days from the date of passage of said Resolution; and WHEREAS, the Boundary Commission of the County of Orange, State of California, did, in session duly assembled, approve the proposed annexation boundaries of said annexation; and WHEREAS, on February 5, 1962, at the hour of 7;30 P.M., in the Council Chambers, in the City Hall, 14'5 West Third Street, City of Tustin, County of Orange, State of Calif- ornia, said time and place being the day, hour and place fixed in said Resolution No. 57? for ~earing protests to the said annexa- tion, the City COuncil did hear and pass upon all protests made to the proposed annexation, and did determine that protests had not been made by the owners of one-half of the value of the privately owned territory proposed to be annexed, as shown on the last equalized assessment roll, nor by public owners of one-half of the value of the p~b'licly owned territory proposed to be annexed~, as determined by said legislative body, and 84' WHEREAS, said territory is contiguous to the City of Tustin, and is uninhabited territory in the COunty of Orange; and NOW, THEREFORE, the City Council of the C.ity of Tustin does hereby approve the annexation of the territory hereinafter described to the City of Tustin, and does hereby further ordain that the said territory be, and the same hereby is annexed to the City of Tustin. That said territory, the annexation of which the City of Tustin has herein approved, is all that territory situated in the County of Orange, State of California, more particularly described as follows: Commencing at an angle point in the High School Annexation No. 2 to the City of Tustin in ac- cordance with Resolution by the Orange County Board of Supervisors, dated January 2~ 1958, said angle point being the intersection of the northwesterly line of the southeasterly one- quarter (1/4) of northeasterly one-half (1/2) of Lot 31, Block 12 of irvine's Subdivision as shown on a map thereof recorded in-Book 1, page 88, Miscellaneous Maps, Records of Orange County, California, with a line parallel to and 30 feet southwesterly of, as measured at right angles to, the surveyed centerline of San Juan Street; Thence, S. 50°07'00~ E. along said parallel : line, a distance of 290.71 feet, to a line parallel to and 40 feet northwesterly of, as measured at right angles to, the surveyed centerline of Red Hill Avenue; Thence, S. 39°51'25'~ W. along said parallel line, a distance of 630.60 feet, to the south- west line of the southeasterly one-quarter (1/4) of northeasterly one-half (1/2} of said Lot 31; Thence, N. 50°06'42~ W. along said southwesterly line, a distance of 290.?2 feet, to the most westerly corner of the southeasterly one-quarter (1/4) of the northeasterly one-half (1/2) of said Lot 31, said corner also being an angle point in said HighsSchool Annexation No. 2; Thence, N. 39°51'25'' E. along said High School Annexation No. 2'boundary line, a distance of 630.?2 feet to the point of beginning. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published once within fifteen days after its adoption in the Tustin News, a weekly newspaper of general circulation, printed, published and cir- culated in the City of Tust~ and said Ordinance shall take effect and be in full force immediately from and after its final adoption.
