HomeMy WebLinkAboutORD 167 (1962) URGENCY ORDINANCE NO. 167 AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED AS "PANNELL ANNEXATION" TO THE CITY OF TUSTIN, CALIFORNIA BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TUSTIN: WHEREAS, on December 18, 1961, the Council of the.City of Tustin did pass and adopt Resolution No. 5?6, declaring that proceedings had been initiated by the City Council of the City of Tustin, California, to annex to said City certain uninhabited territor[ described therein and designated as ~PANNELL ANNEXATION" and giving notice of the proposed annexation, and said Resolution described the bound- aries of the territory proposed to be annexed; and WHEREAS, said Resolution No. 5?6 did contain a notice of the day, hour and place when~and where the Council of the City of Tustin wou!d hear protests made by any person owning real property within the territory proposed to be annexed, the time of said .hearing being not less than forty (40) nor more than sixty (60) days from the date of passage of said Resolution;: and WHEREAS, the Boundary Commission of the County of Orange, State of California, did in session duly assembled, approve the proposed annexat3_on boundaries of said annexation; and WHEREAS, on February 5, ]-962, at the hour of 7:30 P.M., in the Council Chambers, in the City Hall, 145 West Third Street, Cityof Tustin, County of Orange, State of California,.said time and place being the day, hour and place fixed in said Resolution No. 576 for hearing protests to the sa~ annexation, the city Council did hear and pass upon all protests made to the proposed annexation, and did determine that protests had not been made by the. owners of one-half of the value of the privately owned territory proposed to be annexed, as 'show~ on the last equalized assessment roll, nor by oublic owners of one-half of the value of the publicly owned terri- tory proposed to be annexed, as determined by said legislative body, and WHEREAS, said territory is contiguous to the City of Tustin, and is uninhabited territory in the County of Orange; and NOW THEREFORE~ the City Council of the City of Tustin does hereby approve the annexation of the territory hereinafter described to the City of Tustin, and. does hereby further ordain that the said territory be, and the same hereby is annexed to the City of Tustin. That said territory, the annexation of which the City of Tustin has herein approved, is all that territory situated in the County of Orange, State of California, more paricu!arly described as follows: Beginning at an angle point in the South Tustin Avenue Annexation to the City of Tustin, as per Ordinance No. 136, passedand adopted by the City Council of the City of Tustin, July 5, 1960, said angle ooi. nt being in the southeasterly lineof Lot 64, Block !~,-as shown on a map of Irvine's Subdivision, recorded in Book 1, page 88, Miscellaneous Maps, Records of Orange ~ounty, Ca].ifornia, said angle point bearing N. 40 00' E-. D!0 feet from the most southerly corner of said Lot 64 (said southerly corner also being a point in the center line of the Santa Fe Railroad 100 foot right of way]; Thence, from said point of beginning N. 40°00' E. along said southeasterly line of Lot 64, a distance of 285°00 feet to the most easterly corner of'land conveyed by Leila James Wharton, et al to Clarence'Orin Pannell, by deed recorded in Book 1]-50, page 99 of Official Records of Orange County, California; 0 Thence, N. 50 00' W. along a line parallel to the mid southwesterly line of Lot 64 in Block 11, and its northwesterly prolongation a distance of 1350.00 feet more or less to boundary line of said South Tustin Avenue Annexation, said boundary also beingnorth- westerly right of way line of Newport Avenue 60 feet wide; Thence S. ~ o , ~0 00' Wo along said South Tustin Avenue Annexation boundary line 285 feetoto angle ooint in said boundary line; thence, S. 50 00' E. along said annexation boundary line, 1~50.00 feet more or less to point of beginning. This ordinance shall take effect immediately and is an urgency ordinance which is required for the immediate preservation of the public health, safety and welfare of the citizens of the City of Tustin for the following reasons: That it is necessary to allow this property to devetope at its earliest possible moment and to allow the revenue from the development Of the property to be available to the City in order that the City may meet current necessary exp~nses of the City. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published once within fifteen days after its adoption in the Tustin News, a weekly newspaper of general circulation, printed, published and circulated in the City of Tustino PASSED AND ADOPTED by the City Council of the City of Tustin at a regular meeting thereof on the 5th day of February, 1962.
