HomeMy WebLinkAboutORD 163 (1961) ORDINANCE NO. 163 AN ORDINANCE OF THE CITY OF TUSTIN CREATING A PARKS AND RECREATION COMMISSION The City Council of the City of Tustin, California, does hereby ordain as follows: Section 1: There is hereby created a~Parks and Recreation Commission~of the City:of Tustin. Said Commission shall consist of five members, who shall serve without compensa- tion. Said members shallbe appointed by the City CoUncil. The first two commissioners to be appointed shall serve'for a term of three years, and the next two commissioners to be.appointed shall. serve for a term of two years, and the last commissioner to be ap- pointed shall serve for a term of one year. At expiration of the first terms of office of;the original commissioners, the term of eachshall thereafter be for two years. Successors to commissioners whose terms have expired shall be appointed by the City CoUncil. The Council shall appoint successors to fill the unexpiredterm of any commissioner whose office is vacant:due to death or re- signation. Section 2: The Commission shall elect one of its members' as President, who shall hold such office for one year and until his successor iselected. The Commission shall hold regular meetings at such times and places as it deems necessary, and shall establish such rules ahd regulations as it deems necessary for governing itself and for the faithful performance of its duties. Such rules and regulations shall not be inconsistent with the laws of the State of California, or the ordinances of the City of Tustin, California. The Commission shall provide for and do each and all acts which may be found by it,necessary and proper to carry out the provisions and purposes of this ordinance, and to perform the duties imposed.upon it under the provisions hereof. Section .9: The Commission shall manage, supervise, aid and promote, as it deems necessary and proper, all public functions of a public recreational nature or character, including all public recreational activities in or upon parks, playgrounds, athletic fields, ball parks, summer camps, recreation centers, t youth centers, swimming pools, streets,. public buildings,- stadiums, play areas in parks, ten~is courts, and other suitable places or other public lands or public waterways used, owned, controlled or operated by the City of Tustin, either within or without its corporate limits, and the activities in or upon them, and the use of same for athletics, sports, contests, games, community activities, pageants, dramatics, music, public amusements, and other recreational and play programs, and other like activities. Section 4: The ~ity Council shall have power by ordinance to set aside, either absolutely or for a definite period of time, any recreation, under the exclusive jurisdiction of the Parks and Recreation Commission, and the same shall, when and so long as used by the Commission, be unders its ex- clusive jurisc~ction and control, Section 5: The Commission may recommend to the City Council the acquisition of lands, buildings, structures, equip- ment, or other facilities for public recreation, as it may from time to time deem necessary or proper £or the proper conduct of public recreation. It shall have jurisd~tion and control of such facilities. The Commission shall pass upon and approve all plans for the improvement of?lands for public recreation and for the erection, construction or im- provement of buildings or other equipment, structures and facilities for the purpose of public recreation, Section 6: The City Council shall establish a fund, to be known as the "Recreation Fund.~ There shall be d~poSited to and expended from this Fund all fees or monies received by the Commission, including the proceeds from all gifts, legacies or bequests, or other sources managed or controlled by the Commission and derived by it in connection with the q~ration of the public recreational activities and facilities under its jurisdction. All monies in said Fund shall be used for the promotion, supervision and operation of public recreation, as in this ordinance defined, and not otherwise, and if not used during any current year, shall accumulate in said Fund. Section 7: The COmmission may, for and on behalf of the City Council, receive legacies, gifts or be- quests for the purchase, maintenance or improvement of grounds, buildings, equipment or facilities for the purpose of public recreation. All monies received from such legacies, gifts or bequests shall, unless otherwise expressly provided by the terms of such legacies, gifts or bequests, be deposited in the Treasury of the City, in the RecreationFund, and the same may be withdrawn therefrom and paid out only in the manner as is provided for monies legally~appropriated for the supervision, promotion and operation of public recreational programs and purchase of playground equipment and supplies. If'.]'the monies derived from such legacies, gifts or bequests shall at any time exceed in amount the sum necessary for the immediate expenditure fo~.the purposes of public re- creation, then the Commission may investsall or a part of the same in interest-bearing Bonds of the United States of America, or of the State, or of any municipality, or school district thereof. Section 8: The Commission shall report all of its activities not less than annually to the City Council, which said report shall be filed with the City Clerk.
