HomeMy WebLinkAboutORD 146 (1961) ORDINANCE N0.146 AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "SOUTH TUSTIN AVENUE ANNEXATION NO. 2", TO THE CITY OF TUSTIN, AND ESTABLISHING ZONING AND BUILDING SETBACK LINE REQUIREMENTS FOR SAID TERRITORY. BE IT 0RDAINED BY THE COUNCIL OF THE CITY OF TUSTIN: W]~EREAS, on November 21, 1960, the Council of the City of Tustin did pass and adopt !~esolution No. ~38, declaring that proceedings had been initiated by the City Council of the City of Tustin, California, to annex to said City certain uninhabited territory described therein and designated as "SOUTH TUSTIN AVENUE ANNEXATION NO. 2" and giving notice of the proposed annexation, and said Resolution described the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution No. ~38 did contain a notice of the day, hour and place when and where the Council of the City of Tustin would hear protests made by any person owning real property within the territory proposed to be annexed, the time of~said hearing being not less than forty (40) nor more than sixty (60) days from the date of passage of said Resolution; and WttEREAS, the Boundary Commission of the County of Orange, State of California, did, in session duly assembled, approve the proposed annexation boundaries of sai~d ~nnexation; and ~HEREAS, on January 16, 1961, ~t the hour of ?:30 P. M., in the Council Chambers, in the City Hall, City of Tustin, County or Orange, State of California, said time and place being the day, hour and place fixed in said_ ~eso!ution No. ~38 for hearing protests to the said annexation, the City Council did hear and pass upon all protests had not been made by the owners of one-half 'of Ithe value of the orivate!y owned territory proposed to be annexed, as shown on the last equalized assessment roll, nor by public owhers of one-half of the va]_ue of the publicly owned territory proposed to be annexed, as determined by said legislative body, and 720 WHEREAS, said territory is contiguous to the City of Tustin, and is uninhabited territory in the County of Orange; and WHE~EAS, on January 16, 1961, a zoning hearing was held before the City Council for the determination of the zoning and building setback line requirements for the territory to be annexed, regular notice having been given as required by law; and at that said hearing the written recommendations of the Planning Commission of the City of Tustin were received, filed, approved and adopted, the said Planning Commission on January 9, 1961, regular notice having been given as required by law; and the written report and recommendations of the City Engineer having been received, filed, ~pproved and adopted by the ssi~ Plsnning Commission; NOW, THEREFORE, the City Council of the City of Tustin does hereby ~pprove the annexation of the territory hereinafter ~escribed to the City of Tustin, and does hereby further ordain that the said territory be, and the same hereby is annexed to the City of Tustin. FURTHER, the zoning and building setback line requirements for the said territory shall be as shown on the map, marked "Exhibit A", and incorporated hereinand made a part hereof, to be effective upon completion of the said annexation. That said t~rritory, the annexation of Which the City of Tustin has herein approved, is s!l that territory situated in the Comnty of Orange, State of California, ~ore particularly described as follows: A portion of the F. W. ~oll Allotment of the Rancho Sa~ntiago de Santa Ana, described as .follows: 'Beginning at the intersection of the Northeasterly right of ~ay line of the A. T. & S. F. Railroad, said railroad being fifty (~0) feet in ~idth, with the Westerly right of way line of Tustin Avenue, said Tustin Avenue being fity (50) feet in width, said point of beginning bein~ a common angle point in the .boundary lines of the City of Tustin and the City of Santa Ana, thence, S. ~00 11' 0~"., along the city boundary of the City [ 7il of TuSktin, said city boundary also being the North- easterly right of way line of the said A. T. & S. F.. Tustin Avenue; thence, N. 0 19' 1~5,, E., alon~ sai~ right of way line of said Tustin Avenue, a distance of 64.27 feet to the Southerly property line of property conveyed to the S~nta Ana Lumber Company as recorded in Book 5308, Page 2~3, Official rtecords of Orange County, California., and as shown on Ylecords of Survey Book ~7, Page 2~,0 t~ecords of Orange County, California; thence, S. 9 .51' ~9" W., along said Southerly property !i~e, a distance of 111.63 fleet to a point being 290 fleet Southwesterly of, as measured at right angles to, the existing city boundary of the City of Tustin; thence, N. 500 I1' 0.5" W. a distance of ~3.06 feet to the Easterly ri~ht of way line of the Highway Commission; thence, N. 3 . ~along said ZEasterly right of way line, a distance ~f 2~5.71 feet to an angle point in said Easterly ri,~ht of way line, said angle point also being the Southwesterly right of way line of the A. T. & in width; thence, N. 55" E., along said Easterly right of way line of said Newport ~reeway, a distance of fifty (50) feet to an an~te point in said Easterly right of way line of said Newport Freeway, said anyfle point also being the Northeasterly right of way line of said A. T. & S. F.
