HomeMy WebLinkAboutORD 130 (1959)ORDINANCE NO. 130 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, ACCEP- TING AND APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED "PRESC'OTT*BALMFR ANNEXATION" TO THE CITY OF TUSTIN THE CITY COUNCIL OF THE CITY OF TUSTIN DOTS ORDAIN AS FOLLOWS: WHEREAS, on the 31st day of August, 1959, the Council of the City of Tustin did, pass and.. adopt Resolution No. 485, giving notice of the proposal to annex certain uninhabited territory to the City of Tustin, said territory being therein designated as "Prescott - Balmer Annexation" to the City of Tustin, said. Resolution describing the boundaries of the territory proposed.. to be annexed; and WHEREAS, said Resolution No. 485 did contain a notice of the day,,hour and place, when and where the Council of the City of Tustin would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said, hearing being not less than 40 nor more than 60 days from the date of passage of said Resolution; and WHEREAS, on the 19th day of October, 1959, at the hour of 7:30 o'clock P. M., in the Council Chambers in the City Hall of the City of Tustin, County of Orange, State of California, said. time and place being; the day, hour and place fixed in said Resolution No. 485 for hear- ing protests to the said annexation, the said City Council did hear and. pass upon all protests made to the proposed annexation and. did determine that protests had not been made by the owners of one-half of the value of the privately owned territory proposed to be annexed, as shown by the last equalized assessment roll, nor by public owners of one-half of the value of the publicly owned territory proposed to be annexed, as determined by said legislative body;and WHEREAS, in accordance with the provision of Ordinance No. 105 of the City of Tustin, as amended, the Planning Commission and the City Council have duly held public hearings, received a report from the City Engineer, and said Planning Commission has made its recommendations concerning the proposed zoning and building line setback requirements for the territory designated "Prescott - Balmer Annexation" to the City of Tustin; and. WHEREAS, said territory is contiguous to the City of Tustin,' and. is uninhabited territory in the County of Orange; NOW, THEREFORE, the said Council of the City of Tustin does hereby approve the annexation of the territory hereinafter described to the City of Tustin, and does hereby further ordain that the said territory be and is hereby annexed to the City of Tustin. That the zones defined by Ordinance No. 71 of the City of Tustin, as amended, and. the boundaries of said zones, and the building lines, all within the subject territory known as "Prescott -Balmer Annexation", are shown on a map attached hereto, marked Exhibit "A", and made a I¢ part of this Ordinance, beim; designated. as the "Zoning Classification and Building Line Requirements for 'Pres- cott -'Balmer Annexation' to the City of Tustin", and said map and all the notations, references, and. other information shown thereon, shall be,as much a, part of this Ordinance as if the matters and information set forth on said map were fully described herein. That said territory, the annexation of which to the .0 ty of 'ustin is herein approved., is all that territory situated in the County of Orange, State of Calif- ornia, more particularly described as follows: Beginning at an angle point in the boundary line of the City of Tustin, said -point bears Southeast- erly ten feet from the intersection of the South- easterly line of the Northwesterly one-half (1/2) of Lot 32, Block 12, Irvine's Subdivision, as shown on Miscellaneous Record Map Book 1, Page 88, Records, Orange County, California, with the North- easterly line of Laguna Roar, 80 feet in width; 634 Thence Northeasterly, along City boundary 450.0 feet to the Southeasterly prolongation of the Northeasterly line of Block "C" (Southwesterly line of Bonita Street, 60 feet in width) as shown on a map of Martin's Addition, recorded in Book 19, page 79, Miscellaneous Records of Los Angeles County, California; Thence Northwesterly along said Southeasterly prolongation and continuing along the North- easterly line of said Block "C", 64.0 feet to the Northerly corner of said Block "C"; Thence Northeasterly parallel to the center line of Newport Avenue, 60.00 feet wide, and along lot lines 250.00 feet to the Westerly corner of Lot 12 in Block "B" of said Martin's Addition; Thence Southeasterly along lot line, 50.00 feet to the Southerly corner of. said Lot 12 in Block "B"; Thence Northeasterly parallel to the center line of said Newport Avenue and along lot lines 680.00 feet to the Northeasterly line of San Juan Street, 60.00 feet in width, as shown on said Martin's Addition; Thence Southeasterly along Northeasterly line of said San Juan Street, 50.00 feet to a point distant Southeasterly 100.00 feet measured. along San. Juan Street right of way, from its intersection with Southeasterly line of Newport Avenue, 60.00 feet wide; Thence Northeasterly, parallel to Newport Avenue, 150.00 feet to a point; Thence Northwesterly parallel to center line of San Juan Street and its Northwesterly prolongation, 160.00 feet to the Northwesterly .line of said Newport Avenue, 60.00 feet wide; Thence the following courses and. distances based on those shown on Record of Survey recorded in Book 14, page 12, Records of Orange County, Calif- ornia; N. 390 51 ' 30" E. along said Newport Avenue right of way line - 15.00 feet; Thence S. 890 52' 50" W. parallel to the South .. line o M ,n St e , 8O,.(�Q feet ,wi4, -,, 228. 37 feet. to the ::.Tnrhw`tlie.'ok St�itaeelfc t?al�o.a'd .. °_ Station Grounds" as shown on said Record of Survey. Thence S. 390 51' 30" W. along Northwesterly line of said Station Grounds, 643.00 feet to the Easterly prolongation of the center line of Sixth Street, as said street is shown on a map of a part of Tustin ' Cit recorded in Hook 4 Y , page 218 and 219 of Miscell- aneous Records of Los Angeles County, California; Thence S. 890 48' W. along said Easterly prolonga- s - tion 22.10 feet to the Southwest corner of 5.025 p acre parcel of land. as conveyed by deed recorded November 17, 1959, in Book 44.84 Page g 5, Official Records, Orange County, California, from Kenneth "" D. Sloop and wife to W. F. Graves, et al; 638 Thence N. 00 14' 30" W. along west line of said. W. F. Graves, et al, parcel and its Northerly prolongation 817.63 feet to the North line of Main Street, 80.00 feet wide, and City boundary; Thence Westerly, Woutherly, Westerly, Southerly, Westerly, Southerly and. Southeasterly following along city boundary line to the Southeasterly line of Orange Street, 40.00 feet wide, and being an angle point in the City boundary line --and the point of beginning. The Mayor shall sign this Ordinance and. the CD Clerk of the Council shall att-,-,st thereto and, certify to the passage of this Ordinance and shall cause the same to' be published once in the Tustin News, a weekly news- paper of ��,-eneral circulation, grainted, published and circulated in the City of Tustin, said publication to be within fifteen days after the adoption of this Ord= inance. This Ordinance shall take effect thirty days from and after its final adoption.
