HomeMy WebLinkAboutORD 126 (1959)ORDINANCE NO. 126 AN ORDINANCE OF,THE CITY COUNCIL OF THE CITY OF, TUSTIN AMENDING ORDINANCE NO. 71 OF THE CITY OF TUSTIN AND REZONING AND ESTABLISHING BUILDING LINES FOR,, CERTAIN PROPERTY IN THE CITY OF TUSTIN The City. Council of the City of Tustin does ordain as follows: WHEREAS, the owners of the real property described herein- after have filed an application requesting that said pro- perty be rezoned from M-1 to C-2, all in accordance with Ordinance No. 71 of the City of Tustin, as amended; and WHEREAS, said matter has been referred to the Planning Commission of the.City of Tustin and the Planning Commission has given due notice of the time and place for public hearing, before the Planning Commission, concerning said change of zone and establishment of building lines on the subject property; and WHEREAS, a public hearing was duly held on May 25, 1959, before said Planning Commission, and the rezoning and establishment of building lines for that certain real"prop- erty hereinafter described was considered by the Planning Commission, and the Planning Commission having made°certain findings and have recommended to the City Council that said property be rezoned from M-1 to C-2 and that the building lines affecting said property be amended; and WHEREAS, the City Council, after due notice of the time and place for public hearing before the City Council, duly held a public hearing on the rezoning and establish- ment of building lines for said property on June 15, 1959; and WHEREAS, all provisions of Ordinance No. 71, as amended, relating to amendments thereto, have been duly complied with; and WHEREAS, the City Council finds and determines that public necessity, convenience, general welfare, and good zoning practice require the changes in zoning and building line setbacks for said property, as hereinafter described; ,Noy THEAEFOAE, the 'City` Council' of the City of Tustin does ordain as follows: Section 1.= -That that certain real property fronting on the South side. of First ,,Street, between "H" Street and Newport Avenue; more particularly described 9s follows: All that portion of the City of Tustin bounded on the west by "H.'.': Street, on the North by East First Street, on the Southeast by thirty foot in width, S. P. A. R. Co',s right-of-way and on the South, by the center line of Third Street, containing approx- imately 16.60 acres of land: be and the same is Pereby rezoned from M-1 to C-2, and Ordinance No. 71;' as amended, is further amended as above set forth, all in accordance with a map, which map is attached hereto, incor- porated herein and marked "District Zoning and Building Line Map", Plate l3 -A and made apart hereof. The building line requirements for the property hereinabove described are set forth on the map referred to'herein, and, said map is made a part of this Ordinance as if the matters and information set forth on said map were fully described herein. Said building line setback requirements, along that portion of -said property fronting on First Street, shall be 50 feet Southerly, measured at right angles, from the surveyed center line of First Street. It is the intention of the City Council of the City of Tustin that the printed map referred to hereinabove shall prevail over the written description in the event of conflict. Section 2. The City Clerk shall certify to the adoption of this Ordinance and shall.cause the same to -1.)e published once, within fifteen days after its adoption, in the Tustin News, a weekly newspaper of general circulation, printed, published and circulated in the City of Tustin.
