HomeMy WebLinkAboutORD 124 (1959)M ORDINANCE NO. 124 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING AND APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED "IRA L. MARCHANT ANNEXATION NO. 2" TO THE CITY OF TUSTIN. THE CITY COUNCIL OF THE CITY OF TUSTIN DOES ORDAIN AS FOLLOWS: WHEREAS, on the 6th day of April, 1959, the Council of the City of Tustin did pass and adopt Resolution No. 462, giving notice of the proposal to annex certain uninhabited territory to the City of Tustin, said territory being therein designated as "Ira L. Marchant Annexation No. 211, said Resolution describing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution No. 462 did contain a notice of the day, hour and place, when and where the Council of the City of Tustin would hear protests made by any person owning real property.within the territory proposed to be annexed, the time of said hearing being not less than 40 nor more than 60 days from the date of passage of said resolution; and WhEhEAS, on the 18th day of May, 1959, at the hour of 8:00 P. M., in the Council Chambers in the -City Hall of the City of Tustin, County of Orange, State of California, said time and place being the day, hour.and place fixed in said Resolution No. 462 for hearing protests to the said annexation, the said City Council did hear and pass upon all protests made to the proposed annexation and did determine that protests had not been made by the owners of one-half of the value of the privately owned territory proposed to be annexed, as shown by the last equalized assessment roll, nor by public owners of one-half of the value of the publicly owned territory proposed to be annexed as determined, by said legislative body; and WHEREAS, in,accordance with the provisions of Ordinance No. 105 of the City of Tustin, the Planning Commission and the. City Council have duly held public hearings, received a report from the City Engineer, and said Planning Commission has made.lv'ts,, recommendations concerning the proposed zoning and building hire setback requirements for the territory designated,"Ira L. Mar'chant Annexation No. 211; and HE WHEREAS, said territory is contiguous to the City of Tustin, and is uninhabited territory in the County of Orange; NOW, THEREFORE, the said Council of the City of Tustin 'does hereby approve the annexation of the territory hereinafter described to the City of Tustin, and does hereby further ordain that the said territory be and is hereby annexed to the City of ,Tustin. That the zones defined by Ordinance No. 71 of the City of Tustin, as amended, and the boundaries of said zones, and,the building lines, all within the subject territory known as "Ira L. Marchant Annexation No. 211, are shown on a map attached hereto, marked Exhibit "A", and made a part of this Ordinance, being designated as the "Zoning Cla,ssifi- cation and Building Line Requirements for 'Ira L. Marchant Annexation No. 21 to the City of Tustin",.and said map and all the notations, references, and other information shown thereon, shall be as much a part of this Ordinance as if the matters and information set forth on said map were fully described herein. That said territory, the annexation of which to the City of Tustin is herein approved, is all that territory situated in the County of Orange, State of California, more particularly described as follows: Beginning at the Westerly prolongation of the center line of Sixth Street, formerly Sycamore Street (66 feet wide) with the Westerly line of Tustin Avenue, formerly Newport Co. Road (66 feet wide) all as shown on map of the Stafford and Tustin Tract, recorded in Book 2, Page 618, of Miscellaneous Records,.in the office of the County Recorder of Los Angeles County, California. Thence Northerly alongsaid Westerly line of Tustin Avenue 75.00 feet. Thence Easterly 77-00 feet to an angle point in the boundary line of the City of Tustin. Thence South 710 03' 1411 East along Southwesterly boundary line of the City of Tustin, 714.76 feet t,o an angle point in said boundary. Thence continu- ing along said city boundary South 670 321 341, East 158-85 feet to the East line of that certain parcel of land conveyed by C�)arles A. Thorman and Martha J. Thorman to State of California by deed ..recorded April 14, 1953, in Book 2486, Page 76, Official Records, Orange County, Caliofrnia. Thence departing from said City boundary line and. running Southerly along property line, 144.240 feet to the Southeast corner of said parcel. Thence Westerly, parallel to the center line of Sixth Street, and along property line, 169.27 feet to the East line of Lot 110" of said Stafford and Tustin Tract, also being the Southwest corner of parcel conveyed by Charles A. and Martha J. Thorman�to the State of California, by deed recorded in Book 2486 on page 76, Official Records of Orange County, California; thence South 00 481 4511 East along the East line of said Lot 11011, as delineated.on Record of Survey, recorded in Book 26, page 44, records of Orange County, California, a distance of 391.00 feet, more or ..less to a point, distant Northerly 395.03 feet from the Southeast corner of said Lot "011, shown on said "Record of Survey"; thence South 890 05' 0011 West, 729.55 feet along a line parallel to the South line of said Lot 110", and its Westerly extension thereof to the West line of said Tustin Avenue, 66 feet wide; thence Northerly along the West line of said Tustin Avenue ('66 feet wide),756.25 feet to the Westerly prolongation of the center line of Sixth Street, and point of beginning. The Mayor shall sign this Ordinance and the Clerk of'the Council shall attest thereto and certify to the passage of this Ordinance and shall cause the,same to be published once in the Tustin News, a weekly newspaper of general circulation, printed, published and circulated in the City of Tustin, said publication to be within fifteen days after the adoption of this Ordinance. This Ordinance shall take effect thirty days from and after its final adoption. Marchant 5 Annexation No.. 211; and 6 WHEREAS, said territory is contiguous to the City of 7 Tustin, and is uninhabited territory in the County of Orange; 8 NOW, THEREFORE, the said Council of the City of Tustin 9 does hereby approve the annexation of the territory hereinafter 10 described to the City of Tustin, and does hereby further ordain 11 that the said territory be and is hereby annexed to the City of 12 Tustin. 13 That the zones defined by Ordinance No. 71 of the City 14 of.Tustin, as amended, and the boundaries of said zones, and the 15 building lines, all within the subject territory known as "Ira 16 L. Marchant Annexation No. 2", are shown on a map attached hereto, 17 marked Exhibit "A", and made a part of this Ordinance, being 18 designated as the "Zoning Classification and Building Line 19 Requirements for 'Ira L. Marchant Annexation No. 2' to the City 20 of Tustin", and said map and all the notations, references, and 21 other information shown thereon, shall be as much a part of this 22 Ordinance as if the matters and information set forth on said map 23 were fully described herein. 24 That said territory, the annexation of which to the 25 City of. Tustin is,herein approved, is all that territory situated 26 in the County of Orange, State of California, more particularly 27 described,as follows: . 28 Beginning at the Westerly prolongation of the center line of Sixth Street, formerly Sycamore Street 29 (66 feet wide) with the,Westerly'line of Tustin Avenue, formerly,Nevrport Co. Road.(66 feet wide) 30 all as shown on map of the Stafford and Tustin Tract, recorded in Book 2, Page 618, of Miscellaneous Records, 31 in the office of the County Recorder of Los Angeles County, California. Thence Northerly along said 32 Westerly line of Tustin Avenue 75.00 feet. Thence -2- I Easterly 77.00 feet to an angle point in the boundary line of the City of Tustin.
