HomeMy WebLinkAboutORD 121 (1959)- ORDINANCENO. 121 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN AMENDING ZONING ORDINANCE NO. 71 of the CITY OF TUSTIN AND REZONING AND ESTABLISHING BUILDING LINES FOR CERTAIN PROPERTY IN THE CITY OF TUSTIN DESCRIBED HEREIN. The City Council of the City of Tustin does ordain as follows: WHEREAS, the Planning Commission of the City of Tustin duly adopted Resolution No. 515, declaring its intention to. initiate proceedings on its own motion for the rezoning of that certain real property hereinafter described; and WHEREAS, the Planning Commission of the City of Tustin, after notice duly given, held a public hearing to consider objections to the rezoning andestablishment of building lines.of that certain real property more particularly described hereinafter, all in accordance with Ordinance No. 71 of the City of Tustin, as amended; and WHEREAS, the Planning Commission of the City of Tustin, after said hearing, has duly reported its recommendations concerning the rezoning and establishing building lines of said property to the City Council of the City of Tustin; and WHEREAS, the CityCouncilof the City of Tustin, after notice duly given of the time and place for public hearing before said City Council, concerning said rezoning and establishing of building lines, held a public hearing on the rezoning and establishment of building lines,on said property on February 16,1959; and WHEREAS, all provisions of Ordinance No. 71, as amended, relating to amendments thereta, have been duly complied with; and WHEREAS, the City Council of the City of Tustin finds and determines that public necessity, convenience, general welfare and good zoning practice require the within changes in the zoning and building line requirements on the property hereinafter described; NOW, THEREFORE, the City Council of the City of Tustin does ordain as follows: Section 1. That the following described property, situated in the City of Tustin, County of Orange, State of California, be and the same is hereby rezoned from C-2 to R-3: Beginning at the Northerly corner of Lot 53 as shown on a map of Tradt No. 1863 recorded in Miscellaneous Maps, Book 54, Page 20, Records of Orange County, California; Thence. North 400 East, 25-00 feet more or less to the Southerly line of Nisson Road, 50 feet wide; Thence Easterly along the Southerly line of said Nisson Road to the Northerly corner of Lot 11, as shown on a map of Tract No. 2747 recorded in Miscellaneous Maps, Book 82, Page 20, Records of Orange County, California; Thence South 400 West along said tract line, 198.02 feet to the Easterly corner of Tract No. 1863, above mentioned; Thence North 500 West, along said tract line 450.90 feet to the point of beginning. Section 2. Ordinance No. 71 of the City of Tustin, as amended, is further amended as above set forth all in accordance with a map, which map is s attached hereto, incorporated herein, marked "District Zoning and Build Line Map", plate 13, and made a part hereof. The building line requirements for the property herein described are set forth on the map ref -erred to herein and said map is made a part of this Ordinance, as if* the matters and information set forth on said map were fully described herein. It is the intention of the City Council of the City of Tustin that the printed map referred to herein- above.shail.prevail over the written description in the event .of conflict.. Section 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published once, within fifteen days after its adoption, in the Tustin News, a weekly newspaper of.general circulation, printed, published and circulated in the City of Tustin.
