HomeMy WebLinkAboutORD 111 (1957)562 y N ORDINANCE NO. 111 AN ORDINANCE OF THE CITY OF TUSTIN DECLARING THE RESULTS OF THE SPECIAL ELECTION, APPROVING THE "EASTSIDE ANNEXATION TO TUSTIN" AND ESTABLISH- ING ZONES AND BUILDING LINES THEREIN. The City Council of the City of Tustin does ordain as follows: WHEREAS, pursuant to the provisions of Title 4, Division 2, Part 2, Chapter 1, Articles 1 and 2 of the Government Code of the State of California, a special election was duly held on May 28, 1957, in the territory hereinafter particularly described, designated as "Eastside Annexation to Tustin", wherein the following proposition was submitted to the qualified electors thereof "Shall the Eastside Annexation to Tustin be annexed to the City of Tustin?" after first duly complying with each and every applicable provision of law as required; and WHEREAS, the City Council has canvassed the returns of said election and out of the 24 voters eligible to vote, found that 21 votes had been cast and that a majority of the votes were cast in favor of annexing said territory to the City of Tustin, to wit:- 11 votes "Yes", and 10 votes "No"`: NOW, THEREFORE, the City Council of the City of Tustin does ordain as follows: Section 1. The City Council of the City of Tustin does hereby find and determine that a majority of the votes cast at the special election on May 28 ,1957, held in the territory known as the 'Eastside Annexation to Tustin" and hereinafter more particularly described, were in favor of annexing said territory to the City of Tustin. Section 2. That the annexation of that certain in- habited territory contiguous to the City of Tustin designated as "Eastside Annexation to Tustin" be, and the same is hereby approved and annexed to the City of Tustin. Said territory is more particularly described as follows: Beinning at the Northeast corner of Lot 1, in Block �2, as shown on a "Map of Part of Tustin" recorded in Book 13, page 81, Miscellaneous Records of Los Angeles County, California, said Northeast corner of Lot l being an angle point in the City of Tustin boundary line and also being 33 feet South measured at right angles from the center line of First Street, 66 feet in width; T thence Easterly from said point of beginning along the South right of way line of East First Street, 66 feet wide, 1459.65 feet, a little more or less, to the Southerly prolongation of the Westerly line of that certain parcel conveyed to Mararet Suddaby by Deed recorded. January 29, 1939, in Book 659, page 192 Official Records of Orange County, California; thence Northerly along said Southerly prolongation and Northerly along the Westerly line of said parcel conveyed to Margaret Suddaby, 737.251, more or less, to the North line of Lot marked "Leighy"' as shown on a map of "Vanderlip and Rowan Tract" recorded in Book 5, page 160, Miscellaneous Records of Los Angeles County, California; thence Easterly. along the Northerly line of said "Leighy" lot and along the Easterly prolongation thereof 1390.00 feet, more or less, to the Northwesterly line of the Imine Subdivision recorded in Miscellaneous Record Maps, Book 1, page 88, Orange County; thence Southwesterly along the Northwesterly line of the said Irvine Subdivision 2615.00 feet, more -or less, to the Easterly prolongation of the Northerly right of way line of Main Street ( Fourth Street), 80 feet in width, as shown on a map of Yorbats Subdivision, recorded in Book 28, page 10, Miscellaneous Records of Los Angeles County, California; thence Westerly along the Northerly right of way of Main Street (Fourth Street), 80 feet in width, 998.40 feet, more or less, to the East boundary line of the City of Tustin; thence Northerly, Westerly, and Northerly along the boundary line of the City of Tustin to the point of beginning. Section 3. That zones defined by Ordinance No. 71 of the City of Tustin, as amended, and the boundaries of said zones and building lines, all within the subject terri- tory known as "Eastside Annexation to Tustin" are hereby set and established in said "Eastside Annexation to Tustin" and designated and shown on a map attached hereto and made a part of this Ordinance, being designated as the Zoning and Building Line Map for Eastside Annexation to Tustin, and said map and all the notations, references and other infor- mation shown thereon shall be as much a part of this Ordinance as if the matters and information set forth on said map were fully described herein. Section Z}.. The Mayor shall sign this Ordinance and the City Clerk shall attest thereto and certify to the passage of this Ordinance and shall cause the same to be published once in the Tustin News, a weekly newspaper of general circulation, printed, published and circulated in the City of Tustin, and said Ordinance shall take effect thirty (30) days from its final passage.
