HomeMy WebLinkAboutORD 107 (1957)552 ORDINANCE NO. 107 AN ORDINANCE OF THE CITY OF TUSTIN TRANSFERR- ING THE DUTIES OF ASSESSMENT AND TAX COLLEC- TION PERFORMED BY THE CITY ASSESSOR AND TAX COLLECTOR TO THE ASSESSOR AND TAX COLLECTOR OF THE COUNTY OF ORANGE, AND REPEALING ORDIN- ANCES NOS. 39 AND 51 OF THE CITY OF TUSTIN. The City Council of the City of Tustin does ordain as follows: Section 1. The duties of the City Treasurer insofar as they are incident to the collection of taxes and the assessment and tax collection duties performed by the City Assessor and Tax Collector are hereby transferred to the Treasurer, Assessor and Tax Collector of the County of Orange. Section 2. City funds in the hands of the County Treasurer shall be transferred to the City Treasurer from time to time by the County Auditor, or upon written demand of the City Treasurer. Section 3. The City Tax Collector is hereby directed to prepare a list of delinquent tax bills in affidavit form as of the close of 1956-57 fiscal year., to wit, June 30, 1957, and to deliver the same to the Auditor of the County of Orange. Section 4. The personal property tax rate for fiscal year 195758 for the City of Tustin is .9000 per $100.00 of assessed valuation thereof. Section 5. That this Ordinance shall continue in effect from year to year until repealed or amended in this respect. Section 6. Annually, on or before the first Monday in July, the City Clerk with the assistance of the City Engineer shall prepare and file with the County Auditor a description of the exterior ' b.oundariez of each district or portion of the city in which a rate of taxation is to be levied which is different from a rate to be levied in any other district or portion of the city. 0c: Section 7. Annually before the first. day of September the City Council shall fix by resolution the rate of taxes or rates of taxes if different portions or districts require different rates designated in the number of cents upon each $100.00 using as a basis the value of the property as assessed and equalized. The rate shall be sufficient to raise the amount by resolution and the expense of collection. The resolution fixing the rate shall be forthwith transmitted to the County Auditor. Section 8. The City shall pay the County for assessing and'collecting taxes for the city such amount as is determined from time to time by agreement between the Board of Supervisors and the City Council as is provided in Section 51514 of the Government Code. Section 9. Ordinances Nos. 39 and 51 are hereby re- pealed effective with the close of the 1956-57 fiscal year and as the provisions of this Ordinance go into effect prior to said time. All other ordinances or parts of Ordinances to the extent that the same conflict herewith are to that extent hereby repealed. Section 10. Validity. The City Council of the City of Tustin hereby declares that the intent and purpose of this Ordinance is to transfer the city tax functions to the county pursuant to the authority of Article 1, Chapter 2 of Part 2 of Division 1 of Title 5 of the Government Code (Section 51500 et cet) and should any part or portion of this Ordinance be invalid or require interpretation the provisions of said Article 1 shall be deemed to apply. Section 11. Emergency. This Ordinance is hereby declared to be an emergency necessary for the preservation of the public peace, health and safety, and the facts constituting such an emergency are as follows: That a certified copy of this Ordinance must be filed in the Office of the County Auditor on or before, the first Monday in February of 1957 in order to transfer said tax collecting functions for the fiscal year 1957-58; that said transfer will save tax collection expenses, which saving is necessary to enable the city administration to function in such manner as to preserve the peace, public health and safety in the fiscal year 1957-58 on the amount of money lawfully permitted to be raised by property taxation. Therefore, this Ordinance shall become effective immediately upon it's passage and adoption by the City Council. Section 12. Certification and Publication. The City Clerk shall certify to the adoption of this Ordinance, to it's signature by the mayor, to it's attestation by the City Clerk, and shall cause this Ordinance to be published by one insertion in the Tustin News, a weekly newspaper of general circulation printed and circulated in the City of Tustin, California.
