HomeMy WebLinkAboutORD 106 (1957)Nei follows: ORDINANCE NO. 106 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA ACCEPTING AND APPROVING "REVERE ANNEXATION TO TUSTIN.." ESTABLISHING ZONES THEREIN AND BUILDING LINES THEREIN. The City Council of the City of Tustin does ordain as WHEREAS, pursuant to the provisions of Title 4, Division 2, Part 3, Chapter 1, Articles 1 and.5 of the Government Code of the State of California, the following things have been done: The City Council of the City of Tustin did on itis own motion pass a resolution of intention to annex territory pursuant to the Annexation of Uninhabited Territory Act of 1939, said Resolution being Resolution No. 406, dated November 28, 1956; that the territory described in said resolution was approved by the Boundary Commission of the County of Orange; that no part of the subject territory is zoned and restricted for agricultural purposes exclusively; and the City Council of the City of Tustin has found and determined that there were less than twelve registered voters actually residing in the territory described on the date Resolution No. 406 was passed; that Resolution No. 06 designated the area proposed for Annexation as "Revere Annexation to Tustin", and set the date of January 14, 1957, at 8:00 o'clock P. M. for the hearing of protests to be made by any person owning real property within the area of the proposed annexation; that notice of said hearing was duly given as required by law; that at the hearing held on January 14, 1957.9 pursuant to the provisions of Resolution No. 406, there were no protests made by the owners of more than one-half of the value of the territory proposed to be annexed as shown by the last equalized assessment roll; that all things required to be done by law have been done; and WHEREAS, in accordance with the provisions of Ordinance No. 105 of the City of Tustin the Planning Commission has duly held a public hearing, received a report from the City Engineer, and made itis recommendations concerning proposed zoning for the 1. area contained within the "Revere Annexation to Tustin" and has recommended building lines to be established therein: NOW, THEREFORE, the City Council of the City of Tustin does ordain as follows: Section 1. That the annexation of that certain uninhabited territory contiguous to the City of Tustin designated as "Revere Annexation to Tustin", be, and the same is hereby approved and annexed to the City of Tustin. Said territory is described as follows: Beginningg at a point in the West l;ne of Tustin Avenue (66 feet wide) bearing N. 0 171 30" West 288.75 feet from the Southeast corner of the North one-half of Lot "E" as shown on a map of the Stafford and Tustin Tract, recorded in Miscellaneous Records, Book 2, pages 618 and 619, records of Los Angeles County, California, said Southeast corner being in the West line of Tustin Avenue (66 feet wide); thence S. 890 281 10" West, parallel to the center line of First Street, 170.98 feet; thence N. 00 091.0011 West 396.50 feet to the North line of_First Street (66 feet wide); thence West, along the North line of First Street to a point which is distant Westerly 235.80 feet from the West line of Tustin Avenue (60 feet wide) as it exists North of First Street; thence North 200 feet; thence East 315.80 feet to the Westerly boundary line of the City of Tustin; thence Southerly, Southeasterly and Southerly along said boundary line of the City of Tustin to the Easterly prolongation of the South line of the said North one- half of Lot "E" of the Stafford and Tustin Tract; thence West 33 feet to the West line of Tustin Avenue; thence Northerly along the West line of Tustin Avenue to the point of beginning. Section 2. That zones defined by Ordinance No. 71 of the City of Tustin, as amended, and the boundaries of said zones and the building lines, all within the subject territory known as "Revere Annexation to Tustin" are shown on a map attached hereto and made a part of this Ordinance, being designated as the "Zoning and Building Line Map for Revere Annexation to Tustin", and said map and all the notations, references and other information shown thereon shall be as .F much a part of this Ordinance as if the matters and information set forth on said map were fully described herein. Page 2. Section 3. The Mayor shall sign this Ordinance and the City Clerk shall attest thereto and certify to the passage of this Ordinance and shall cause the same to be published once in The Tustin News, a weekly newspaper of general circulation, printed, published and circulated in the City of Tustin, and said Ordinance shall take effect thirty days from it's final passage.
