HomeMy WebLinkAboutORD 091 (1955)ORDINANCE NO. 91 AN ORDINANCE AMENDING ORDINANCE NO. 71 ZONING "PRESCOTTIS ANNEXATION TO i THE CITY OF TUSTIN" i The City Council of the City of Tustin does ordain as follows: j WHEREAS, certain territory has recently been annexed to the City of Tustin and said territory is known as "Prescptt's Annexation"; and WHEREAS, the Planning Commission.of the City of Tustin has declared its intention to recomrrmehd zoning for said territory and has duly considered said intention after public hearing duly held; and WHEREAS, said Planning Commission has made its recommendations to the City Council; and WHEREAS, the City Council held a public,hear- ing on said proposed amendment to Ordinance No. 71 on January 10, 1955s and has considered the same: Section 1. The following described area is hereby zoned for uses described as Local Commercial (C-1) in Ordinance No. 71: The North 100 feet of "Prescottis Annexation to the City of Tustin." Section 2. The following described area is hereby zoned for uses described as sight Industrial Pur- poses (M-1) in Ordinance No. 71: The area described as "Prescott*s Annexation to the City of Tustin," excepting therefrom the North 100 feet thereof. That said areas are shown on a map attached hereto marked "Zoning Map for Prescottâ–ºs Annexation -or- dinance No. 91 Amendment to Ordinance No. 71," and made a part hereof.. That it is the intention of the City Council that the printed map shall prevail over the written de- scription in the event of a conflict. Section 3. If any section, subsection, sentence, clause, ,phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordin- ance. The Council hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, clauses,_ phrases or por- tions be declared invalid or unconstitutional. Section 4. The City Clerk shall certify to the adoption of this Ordinance, to its signature by the Mayor, to its attestation by the City Clerk and shall cause this Ordinance to be published for one insertion in the Tustin News, a weekly newspaper of general circulation, printed and circulated in the City of Tustin, Orange County, Calif- ornia.
