AN ORDINANCE OY THE CITY OF TUSTIN RE- 5 PEALING ORDINANCE'NOS. 21 AND 53 OF THE CITY OF TUSTIN AND ADOPTING AN ELECTRICAL CODE FOR THE CITY OF TUSTIN AND PROVIDING FOR THE APPOINTMENT OF A CITY ELECTRICIAN. THE CITY COUNCIL OF,THE CITY OF TUSTIN DOES.ORDAIN AS FOLLOWS: Section 1. That portion of a ce-rt&in document$ three (3) copies of which are on file in the office .,of -the City Clerk of the City of Tustin, being marked and designated as "ORANGE COUNTY ADMIN ISTRATIVE ELECTRICAL ' CODE," on .whi.eh the date of ,January 1, 19519 is stamped, be and the same i.s .hereby adopted as the Electrical Code of the City of Tustin for .regulating the erection, construc- tion, emlargement, alteration, repair., moving., removal, demolition, conversion, occupancy, equipment, use, anal-maintenanee of elect rival connections, equipment, fixtures and -any -,other -fabrication in which electrical current is to be used or.eonducted through, in the City of Tustin; providing penaitiesfor violation of such " code; and each and all portions of the regulations, provisionss penalties, conditions, and terms of such electrical code of,the City of Tustin, on file in the office of the City Clerk and here- by referred to., are hereby adopted, and made a part hereof as if fully set out in this Ordinance. Section 2. That for the purpose of adapting that document entitled "ORANGE COUNTYADMINISTRATIVE_ELECTRSCAL CODE" for use as the eleetrieal code of the City of Tustin, the word's "-County Building Inspector, "County. Electrician," and "County Electrical Inspector," shall be taken to mean "City Building Inspectors" "City Electrician," and "City Electrical Inspector," and those references in said document to the applicability of the Code to the unincorporated territory of the County of Orange, shall be taken to mean the incorporated area.of the City of Tustin, and that in all respects said Code shall be interpreted and used as a city electrical code`. Section 3. A. That subsection A. of Section l is hereby amended to read as follows: "A, City Electrician. Whenever the phrase entitled "City Electrician" is used in this Ordinance, the same shall be taken and construed to mean the Building Inspector of the City of Tustin, duly authorized and appointed as in this Ordinance provided, or any person who has been regularly appointed as Building Inspector or.Deputy Building Inspec- tor of the City of Tustin, to serve as Electrical Inspector for the City of Tustin. B. That Section 2 is hereby amended to read as follows: "Section 2. Organization of ..the Board. of Examiners. The Board, to be Mown as the Board of Examiners of Electric- ians of the County of Orange, shall be the Board of Exam- inere referred to in this Ordinance." C. That Section 8 is hereby amemded to read as follows: "Section 8. Cancellation of Licenses. The City Council of the City of Tustin may suspend or revoke licenses as to the City -of Tustin of any electrician_ licensed hereunder for the violation of this Ordinance or for incompetency." D. That subsection A. of Section 9 is hereby amemded to read as follows: "A. It shall be the duty of each master electrician to com- ply with all requirements of this and.all other Ordinances Of the City of Tustin, as well .as_ .all laws of the State of California, applicable to electrical work." E. That subsection A. of Section 11 is hereby amended to read as follows: "A. It shall be the duty of every maintenance electriciat to comply with all requiremebts of this and all other Or- dinances of the City of Tustin, as well as all laws of the State of California, applicable to electrical work.i� F. That subsection A. of Section 12.1s. hereby amended to read as follows* "A* No electrical permit shall be issued by_the Building Inspector to any person who is not the legal a valid Master-Electricianl`Certificate,possessor of. f Qualification provided that the Building Inspector may issue to the owner of the legal or equitable title to any property in the in- corporated territory of the City of Tustin used exclusively for residence, to alter, repair or install any electrical wiring or equipment in or on buildings or premises in con- nection with such residence or acessory buildings, pro- vided that the said electrical work is done by himself, or a member of his household." G. That Section 13 entitled "FEES FOR PERMITS AND INSPEC-- TIONS" is hereby amended by striking therefrom."Building Inspec- tion Department" and inserting'in place thereof the words "City Clerk of the City of Tustin." H. That a new Isection is hereby added to said ORANGE COUNTY ADMINISTRATIVE ELECTRICAL CODE, in force and -.effect in the City of Tustin as the electrical code of the City of Tustin, at the and of Section 13 thereof, to he known as Section 13.5, which said new _section shall read as follows, to -wit: LL LL 360 "Section 13.5. Minimum Inspection Fees. Notwithstanding anything contained in Section 13 above, the following Mini- mum Electrical Inspection Fees shall be charged in -the City of Tustin A. A minimum fee of $2.00 for work requiring not more than one (1) electrical inspection, which jobs shall be designa- ted by the Building Inspector or Electrical Inspector by such regulations as he will prescribe, and keep a copy thereof in the office of the City Clerk of the City of Tustin. B. Minimum Inspetion. Fee for New Dwellings.. Notwithstanding any of the 'provisions contained in Section 13_ above, the min- imum inspection fee for, a new dwelling shall be 04-00- I. That Section i4is hereby amended by striking the words nCounty EleetrieianT' and substituting therefor "City Electrieian,'r whenever that name occurs in said Seetion,.and.said Section is fur- ther amended by the addition thereto of the following sentence: "that notwithstanding anything else herein contained$ no certificate of approval for electrical work shall be issued unless the fees required by Section 13 and Section 13.5 have been paid as hereinabove provided for." J, That Section 15 is hereby amended by striking therefrom the words "County Electrician" whenever they occur and substituting therefor the words "City Electrician,' and said Section is further amended by striking therefrom these words "County of Orange," and substituting therefor the words "City of Tustin." K. That.subseeti:on A of Section 16 is hereby amended by striking therefrom the words "unincorporated -area of the County of Orange" and substituting therefore the words :;'incorporated area of the City of Tustin." Section 4. Appointment of City Electrician. The City Council of the City of Tustin shall by resolution appoint a City Electrician for the City of Tustin, wha shall hold office during the pleasure of said City Council. The City Electrician shall function as a de- puty of the Building Inspector if he is a person other than the Building Inspector or Building Official of the City of Tustin. Said City Electrician may also be known as the Electrical Inspector for the City of Tustin and shall receive such compensation for his ser- vices as may be fixed and determined by resolution of said City Council. Section 5. Ordinance No. 21 of the City of Tustin and Or- dinance No. 53 of the City of Tustin are hereby repealed, and all other Ordinances., or portions of Ordinances., with the extent.that the same conflict herewith, are to that extent hereby repealed. Section 6. Any person, persons or corporation violating any of the provisions contained in this Ordinance shall be deemed guilty of a misdemeanor, and shall be punished by a fine of not less than Ten Dollars 010.00) nor more than Five Hundred Dollars (0500.00) or by imprisonment for not more than six months in the County Jail of the County of Orange, or by both such fine and imprisonment. Section 7. If any section, subsection.,sentence, clause or phrase of this Ordinance, is for any reason held to be unconstitu- tional, such decision shall not affect the validity of the remain- ing portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and.each section, sub- section, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases may be declared unconstitutional. Section 8. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published.once in the Tustin News, a weekly newspaper of general circulation, print- ed, published and circulated in the City of Tustin, Orange County, California, and said Ordinance shall take effect and be in full farce and effect thirty (30) days from the date of its final pas- sage* PASSED AND ADOPTED by the City Council of the City of Tustin at its regular meeting held on the 2nd day of January, 1951, ATTEST** 2gCit C rk��2 ��% City Mayor STATE OF CALIFORNIA) COUNTY OF ORANGE CITY OF TUSTIN ) I, S.
