The City Council of the City of Tustin does ordain as
follows:
SECTION :1 Except as othej*lte provided the minimum
standards, provisions and requirements.for safe and stable de-
sign.. methods of'construetion and quali°ty of materials, use and
occupancy,' location and maintenance of all buildings or struc-
tures within the City shall'be in accordance with the provisions
and in the manner prescribed by the--Mif'orm. Building ;Code, 1949
Edition, adopted by the, Pacific Coast .Bu12dAn '._:O `ficials Confer-
eM6, which said uniform code hereby is- adopted, three printed
copies of Whid#, in'book form, were filed prior to the adoption

of this Ordinance and are now on file'in the..Office of the City
Clerk of the'Cty of Tustin for the use of and examination by
the public.
SBUT ON''20' The following sub -sections and paragraphs
hereby are added to the aforesaid -Uniform. Building Code, 1949
Edition, and macre a part thereof and.. shall_ have full "force and
effect in the City of Tustin:
(a) To Section 202, as sub -section (f).. BUILDING OFFI-
CIAL:
The Building OffIcial'hereby is authorized and it
shall be his duty to enforce provisions of -the
Electrical Code, '(Ordinance No.: 21, as amended by
Ordinance -No. 53)" and the Plumbing Code, (Ordin-
ance No 57, as amended) and: the Zoning Code,
(Ordinance " No. 71') ., and' such_ . amendments to the
aforesaid Ordinances as there.may, be made thereto
from time to time,and such other ordinances as
may be adopted from time to time in Which further
duties are specifically assigned to him.; No over-
sight or dereliction on the part, of the Building
Official or any of his deputie.s_.shall' make lawful
the violation of ,any 'of the _prov s:ions of any ordin-
ance of` the City of -Tustin.
(b) To Section 303; (b) _after: the word "feel' add
the following words:

(c) To Section 303, as sub -section (c),'INSPECTION
FEES:
For each inspection required under this Ordin-
ance known as the Uniform.B.uilding.C.ode, the builder
must pay the sum of $2;00, and this shall apply to
all called inspections which..reveal def"eetive or
incomplete work requiring reinspection.
In determining. the to:taT: ao.st of the building
permit and the inspection fees, that money due for
the building permit as provided for in Section 303
(2) "shall first be used .to coves the cost of is-
suing the permit wh ch.is.._her.eby fixed at $1.00,
and then to cover the cost of inspections as pro-
vided for in this section, and..that f''t is in-
sufficient to cover such costs,. then additional
money shall be paid by the builder either from
the Inspection Fee Deposit or directly from the
buil"der before the final_.. insp-ection shall have
been completed:
(d) To Section 303, as sub. -section (d) "INSPECTION
FEE DEPOSIfir
That before any building permit is issued
there must be deposited with.the 3`ssuing Official
a fee to cover the cost of` inspections required
for the proper completion.of..the construction
authorized by the said pe_rmi.t, .a_fee deposit from
which the cost of" the "build.i:ng.._p_erm,it may be taken, "
but which shall not, in any event, be less than
$12.00.' If after the final inspection of the con-
struction the whole of 'said 1Z.00'...shall not have been
used to defray the cost of the inspections and permit
fee, the applicant shall_ .be entitled to a refund of
that amount pad'in excess of the cost. of the building
permit .and the cost -of inspections. f"or said building,
if any.
The 'Treasurer of'the City of Tustin is hereby
authorized, upon completion,of ;the._.construction done
under the permit, to pay such -refund -.6f the inspection
fee deposit as may be cert:ified.to by the Building
Official.
SECTION 3. That Ordinance No. 70, 'entitled, "An Ordinance
of the City of Tustin Regulating .the .Ere e.tlon., _Construction, En-
largement, Alteration, Repair, Moving, Removal., Demolition, Con-
version, Occupaney, Equipment,"Use, Height, Area and Maintenance
of all Building and/or Structures in the City of Tustin; Providing
for the Issuance of Permits and Collection. of.:F'ee.s "Therefor; Pro-
viding Penalties for the Violation Thereof. Declaring and Estab-
lishing F"i"re "Zones, and Repealing Ordinance No. 56 of the City of
Tustin" is hereby amended by deleting therefrom and repealing
Sections 1,, 3, 4 and"5;thereof
SECTION 4. All other ordinances, or portions of ordinances
to the extent that the same conflict herewith -are to thgt extent
hereby repealed.
SEECTION 5. If. any section, sub -section, sentence, clause,
or phrase of this Ordinance is for any reason held to be uncon-
stitutional, such decision shall not 'affect the validity of the
remaining portions of this,Ordinance. The City Council hereby
declares that it.would have passed thi_s_.Ordinance_and each section,
sub -section, sentence, clause, or phrase thereof .-irrespeetive of
the fact that any one or more sections, sub -sections, clauses or
phrases be declared unconstitutional.
SECTION 6. 'The City Clerk shall certify to the passage
of this Ordinance and shall cause the same, to_be published once
in the Tustin News, a weekly newspaper of general circulation,
printed,.published and circulated in the. City _of' Tustin, Orange
County, California, and said Ordinance shall -take effect and be

in full force and effect immediately from the date of .its final
passage and adoption.

that the foregoing Ordinance was introduced. -at a,regular meeting
of the City Council of the City of Tustin, held:.on the 19th day of
September, 19 .9, and was passed_ by the. City . C'ounci`l at a regular
adjourned meeting held on.the 3rd day of. October -.,'1949,, by the
following vote:
AYES: Councilmen: Gray, Miller., Bacon and Humeston.'
