HomeMy WebLinkAboutORD 72 (1947)ORDINANCE NO. 72 ':moi ORDINANCE OF THE CITY OF TUST'IN REGULATING THE ISSUANCE OF PERMITS FOR FOOD HANDLING BUSINESSESf AND PROVID- ING A PENALTY.FOR THE VIOLATION THEREOF. The City Council of the City of Tustin doordain as follows:_ SEC. le it shall be unlawful for any person, firm, or cor— poration owning, controlling or leasing, acting as an agent for, t conduoting, operating or managing any restaurant, cafe, lunch counter, cafeteria, soda fountain, ice cream parlor, soft drink stand, fruit and vegetable stand, grocery, meat markets bakery$ popcorn, peanut or other food vending stands or stations, or food processing or =w=fa— cturing plants, bottling plants, or other places or vehicles in the City of TUSTIN where food is prepared for sale, sold, distributed, or displayed .for sale, to conduct or operate, or cause or permit to be conducted or operated, in said City of TUSTIN such restaurant, -cafe, lunch counter, cafeteria, soda fountain, ice cream parlor, soft drink -stand, fruit and vegetable stand, grocery meat market, bakery, popcorn, peanut or other food vending stands or stations, or food processing or manufacturing plants, bottling plants or other places or vehicles where food,; i.s,,, p.r_ep.ared.fo.r..sal.es sold, distributed, or displayed for sale, or for any person to sell, or offer for sale, or cause or permit to be sold or offered for sale, any food or, -drink _therein or therefrom without first applying for Aid receiving from the Health Department of the City of TUSTIN a permit therefor. A permit, for which application is made under the provisions of thie Ordinance, may be granted at any time during-the year, but all permits granted hereunder shall expire concurrently with the city ' business license issued for the corresponding periodl A permit may be i temporarily suspended by the health office upon violation by the holder of any law, ordinance, or regulating ;goveraing food san%Jtfon4..,o revoked aft:er._ a hearing. by the, health officer. SEC. Z. . It shall b.e Lawful.- foranymember or employee of the Health Department of the City of Tustin to enter upon nay premises herein mentioned at any time for the purpose of inspecting the same and. any member,. of -the_ Health Department may require any person owning a permit under this ordinance to produce the same for inspection. If j such. ,inspection be refused. th.e.:p.ermit shall-.be forthwith revoked. i SEC. 3. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon con— f t t viction thereof shall be punishable with a fine not exceeding FIVE HUNDRED.($500.00) DOLLARS, or by imprisonment in the County Jail, of the County of Orange, 4or a period of not exceeding one hundred and eighty (180), days, or;by both fine and imprisonment. PROITIDED,`That this ordinance shall not apply tQ o3gax stands, or other places or vehicles of `business, where no food'of any kind or nature is offered for sale or sold other,than candy or soft'driaks received in sealed packages, or boxds, or bottles where the seal or seals on said packages or boxes are not broken prior to sale thereof. SEM. 4. CERTIFICATION AND PUBLICATION. The City Clerk shall certify to the adoption of this Ordinance, to its signature by the�M yor, of its attestation by the City Clerk and shall cause this Ordinance to be published by one insertion in the TUSTIN NEWS, a weekly newspaper of general circulation$ printed and circulated in the City of Tustin, Orange Couhty, California. PASSED AND ADOPTED by the City Council of the City of Tustin, at its regular meeting held on the L day of August, 1947.
