HomeMy WebLinkAboutORD 62 (1942)0 follows; ORDINANCE NO. 62 AN ORDINANCE OF THE CITY OF TUSTIN RELATING TO RESTRICTED LIGHTING The City Council 66 the City of ,Tustin does ordain as Section 10 J.L. DeWitt, Lieutenant General, U.S. Army, Commanding Western Defense Command and Fourth ATMVI by vir— tue of the authority vested in him by the President of the United States and Executive Order No. 9066, dated February 19,1942, and pursuant to Public Law 503- . 77th Congress, approved March 21, 1942, and by virtue of his powers and prerogatives as Commanding General of the Western Defense Command, has issued Public Pro— clamation No. 10, dated August 5, 1942,, and effective August 20, 1942, -which as amended by Public Proclamation No. 12, dated October 10, 1942s and issued by virtue of the,same authority, are on file in the office of the City Clerk of the City of Tustin, and in the office of the Chief of Police of the City of Tustin, and said proclamations are bye reference thereto made a part here— of to the same extent and purpose as if the same were herein set out in full. Section 2 That the City of Tustin is within the zone of restricted lighting as shown by said proclamations mentioned in the foregoing paragraphs Section 3- The City of Tustin hereby recognises the civil and military necessity for the concurrent enforcement of the provisions of Public Proclamation No* 10, as amended as afore— said, by the City of Tustin and the federal government. Section 4. The City of Tustin is Within the Zone of Restricted Light ftj designated and established by,Section 2 of s8i�lrPube ,saat�$a�n.fO '&4=amended as aforesaid. Section 5# Whoever on or after the effective date of this ordinance commit any act in the City of Tustin contrary to the provisions of Sections 2 or 3 of Public Proclamation No. 10 as amended as aforesaid, which amended proclamation is hereinabove set ; forth in full, shall be guilty of a violation of this ordinance which 272 violation shall constitute a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed $300.00 or by imprisonment for not to exceed three months, orby both such fine and imprisonment. Section 6. This ordinance isrequiredfor the immediate preservation of the public peace, health and safety, and shall take effect immediately. The following is the statement of facts constituting such urgency: The United States is at war and this city by -the provisions of Public Proclamation -No., 10 as amended by Public Proclamation No.12 is 14cated in a military zone of restricted lighting established as a matter of military necessity in order to minimize the danger of -enemy attack and to provide maximum protection for war utilities, -war materials and war pre— mises. By reason of the immediate threat of enemy attack compli- anee with the provisions of Public Proclamation No. 10 as amended by Public Proclamation No.: 12 is essential for the protection of the lives and property of the people of the city of Tustin. Section 7. The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Tustin News, a newspaper of general circulation printed and publisbod�4Ln -thi''s'city, whereupon this ordinanceshall take effect immediately.
