HomeMy WebLinkAboutORD 57 (1942)ORDINANCE NO. 57 AN ORDINANCE OF THE CITY WrT USTIN PROVIDING FOR THE APPOINTMENT OF A PLUMBIiNG INSPECTOR, DEFINING HIS DUTIES AND FIXING HIS COMPENSA- TION; REGULATING THE METHOD OF CONSTRUCTING PLUMBING WORK, HOUSE DRAINAGE AND GAS FITTING, PROVIDING FOR THE INSPECTION THEREOF`?AND�.THE ISSUANCE OF PERMITS THEREFOR; PROVIDING A PENALTY FOR THE VIOLATION OF SAID ORDINANCE; AND REPEALING ORDINANCES NuUBEREi) 22 and 54. Cailfornia, does hereby ordain as follows: Section 1; Tnat a portion of a certain printed code M Yl V V r �`v J in book form, three copies of whion are on file in the office of the City Clerk of the City of Tustin, being a code adopted by the City of Santa Ana by Ordinance No. 821 and amended by Ordinance No. 1050 of the City of Santa Ana, and 'being marked and designated as "an ordinance providing for appointment of a plumbing inspector, defining nis duties and fixing his compensation; regulating the metnod of constructing plumbing work, nouse draining, gas hitting, etc,," be and ttie same is hereby adopted as the Plumbing code of the City of Tustin, establiening rules and regulations for the installation of plumbing, nouse drainage and gas fitting in the City of Tustin, and said code is hereby made a part of this ordi nance by reference to the same effect as if Pully.set forth in this ordinance. Section 2: That the portions of said code so adopted are as follows: Section l to Section 3, ootn sections included; and also Section 6 to Section 17, botn sections included, and"also Section 21 to Section 23, bot- sections included; and also Section 29, be - on page 14, to Section 73, ootn sections included; and also Section 74, beginning on page 24, to Section 135, both sec- tions included;<and also"Section 140 to Section 154, beginning on page 43, nota sections included; and also Section 155 to Section 214, both sections included; and also Section 215, beginning on page 61, to Section 220, botn sections incluaed. Section 3: Tnat said plumbing code so adopted is nereoy amended as follows: Tnat arnerever the words "C-ity of Santa Ana" appear in said code, or in any paragraph, sentence or heading Tnertof, the M same is hereby amended to read "city of Tustin". Section 4: That a new section is hereby added to said plumbing code at the end of Section 1( tnerof, to be known as Section 18) waicn said new section shall read as follows, to—wit; Section 18; It is unlawful for any person �. to carry on ousiness or labor as a master or journey— man plumper, in the City of Tustin unless ne has oo— tained from tae ooard of nealtn of said city a license autnorizing nim to carry on that ousiness, or to labor as such mechanic. Section 5: That a new section is nereoy added to said plumbing code at the end -of Section 16 above adopted, to oe known as Section 19, which said new section shall read as follows, Section 19: A license sna.11 be issued only after a, satisfactory snowing to the city poard of health that applicant has successfully passed a regular plumo— ing examination given by an incorporated city within the County of Orange or has passed the regular plumbing,ex— amination given by the County of Orange. Section b: That any person, firm or corporation violat— ing any of the provisions of tnis ordinance snall be guilty of a misdemeanor, and upon conviction thereof shall be punisned by a fine not exceeding $300.00 or by imprisonment in the County Jail for a period not exceeding ninty (90) days, or by both such fine and imprisonment. Section 7: If any section, subsection, sentence, clause or phra.se.of this Ordinance, is for any reason held to be unconstitutional, such decision snail not affect the validity of the remaining portions of this Ordinance. Tne City Council here— by declares that it would nave passed this Ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or,more sections, subsections, sentences, clauses and phrases be declared unconstitutional. Section S: That Ordinances numbered 22 and 54 are hereby repealed, and all other ordinances, or;portions of ordi— nances to the extent that the same conflict.herewith, are, to that extent, hereby repealed. M Section 9: Tne City Clerk shall certify to the pas— sage of tnis Ordinance and shall cause tune same to be publisned once on the Tustin News, a weekly newspaper of general circula4 tion, printed, published and circulated in the City of Tustin, Orange County, California, and said Ordinance snall take effect and be in iull force and effect thirty (30) days from the date of its final passage and adoption.
