Washington, D.C. 20036 Attn: Mr. George Schlossberg, Esq. ~ FfLE CQPY Recorded in Official Records, County of Orange Tom Daly, Cferk-Recorder (IINI IIIII IINIlIIII IIIII IINI IINI IINI IIVI IIIII IIIII Ilill IIIII NO FE E 200400016806810:12am 03/03/04 130 42 E01 A04 6 o.oo a.oo o.oo o.oo o.oo o.oo o.oo o.ao This Space is Reserved for Recorders Use Only `j ~. ~ QUITCLAIM DEED OF EASEMENT FOR RIGHT OF WAY DEDICATION 1 THIS QUITCLAIM DEED OF EASEMENT, made this~t+a, day of t,~ ~y2004 by and 2 between the UNITED STATES OF AMERICA, acting by and through the SE~TARY OF 3 THE ARMY, (hereinafter referred to as the GRANTOR"), under and pursuant to the Federal 4 Property and Administrative Services Act of 1949, as amended 40 U.S.C. §484, and the delegation 5 of authority to the Secretary of Defense from the Administrator of the General Services 6 Administration (41 C.F.R. 101-47.601), and the delegation of authority from the Secretary of 7 Defense to the Secretary of the Army (20 F.R. 7113), and the CITY OF TUSTIN, CALIFORNIA, 8 recognized as the Local Redevelopment Authority by the Office of Economic Adjustment on behalf 9 of the Secretary of Defense for the former Marine Corps Air Station Tustin (hereinafter referred to 10 as the "GRANTEE"). 11 12 WITNESSETH THAT: 13 14 WHEREAS, GRANTOR and the GRANTEE have entered into a Memorandum of 15 Agreement Between the United States of America Acting By and Through the Secretary of the 16 Army or Designee and the City of Tustin, California, dated the 21st 'day of September, 2000 17 (hereinafter referred to as the "MOA"); 18 19 WHEREAS, the MOA sets forth that the Easement, as defined below, is granted, remised, 20 released, and forever quitclaimed by the GRANTOR to the GRANTEE to facilitate the 21 development of a public road. 22 23 NOW, THEREFORE, the GRANTOR, for good and valuable consideration does hereby 24 grant, remise, release, and forever quitclaim unto the GRANTEE, its successors and assigns, in 25 perpetuity, an assignable easement ("Easement") consisting of an eighty (80) foot wide strip of land 26 abutting Barranca Pazkway including an existing thirty (30) foot easement and an additional fifty 27 (50) foot wide right-of--way, over, under, through and across all such interest, rights, title, and claim 28 as the GRANTOR has in and to the Property, more particularly described in Exhibit "A," which is 29 attached hereto and made a part hereof, to construct, repair, replace, access, and maintain a road artd 30 related improvements, subject to the exceptions, reservations, restrictions, covenants and conditions 31 hereinafter expressed and set forth. The GRANTOR shall not interfere with the construction, repair, 32 replacement, access and maintenance of such public road. ~' 3 ; ``• i._~ L 03-37059.7 MCAS TUSTIN: QUITCLAIM DEED OF EASEMENT 2 The Easement is made subject to the following reservations and easements: 3 4 (1) All existing exceptions, reservations, restrictions, covenants, conditions and 5 easements of record. 6 (2) Covenanting to the GRANTOR, and its assigns, the promissory right and easement 7 for ingress and egress to permit the GRANTOR access to its adjoining land. 8 (3) GRANTOR may terminate this Easement if the GRANTEE fails to construct a 9 Public Road on the Property within twenty (20) years of the date of the execution of this Easement. 10 11 II. Property Conveyed "As Is" "Where Is" 12 13 Except as expressly provided for herein, the Easement is conveyed in an "as is", "where is" 14 condition, without any representation or warranty whatsoever by the GRANTOR concerning the 15 state of repair or condition of said Property. 16 17 III. Environmental Issues 18 19 GRANTOR covenants that any remedial action due to the former military activity on the 20 Property found to be necessary after such date of transfer shall be performed by the United 21 States. 22 23 IV. ,Notice of Non-Discrimination 24 25 With respect to activities related to the Property, the GRANTEE covenants for itself, its 26 successors and assigns that the GRANTEE, and such successors and assigns shall not discriminate 27 upon the basis of race, color, religion, sex, age, handicap, or national origin in the use, occupancy, 28 sale or lease of the Property, or in their employment practices conducted thereon in violation of the 29 provisions of Title VI of the Civil Rights Act of 1964, as amended (42 U.S.C. Section 2000d); the 30 Age Discrimination Act of 1975 (42 U.S.C. Section 6102); and the Rehabilitation Act of 1973, as 31 amended (29 U.S.C. Section 794). The Army shall be deemed a beneficiary of this covenant 32 without regard to whether it remains the owner of any land or interest therein in the locality of the 33 Property hereby conveyed, and shall have the sole right to enforce this covenant in any court of 34 competent jurisdiction. 35 36 THE CONDITIONS, RESTWCTIONS, and COVENANTS set forth in the Easement 37 are a binding servitude on the herein conveyed Property and will be deemed to run with the land in 38 perpetuity. Restrictions, stipulations and covenants contained herein will be inserted. by the 39 GRANTEE verbatim or by express reference in any deed or other legal instrument by which it 40 divests itself of either the Easement or any other lesser estate in the Property or any portion thereof. 41 Al] rights and powers reserved to the GRANTOR, and all references in this Easement to 42 GRANTOR shall include its successor in function.
