AN ORDINANCE OF THE .CITY COUNCIL OF THE CITY OF
3 TUSTIN, APPROVING ZONE CHANGE 99-002, AMENDING THE
EAST TUSTIN AUTO CENTER PLANNED COMMUNITY
4 REGUALTIONS TO CONDITIONALLY ALLOW ANCILLARY
5 BANQUET FACILTITES IN THE TUSTIN AUTO CENTER.
*-- 6 The City Council does hereby ordain as follows:

i. The City Council finds and determines as follows:
A. That a proper application was filed for Zone Change 99-002 to
9 amend the East Tustin Auto Center Plannea Community Regulations
~0 to conditionally allow ancillary banquet facilities in the Tustin Auto
Center aS identified on Exhibit A attached hereto.
B. That on May 24, 1999 the Planning Commission recommended that
~2 the City Council approve Zone Change 99-002 to conditionally allow
~s ancillary banquet facilities within the East Tustin Auto .Center
Planned Community.

~5 C. That a public hearing was duly called, noticed and held on said
application on June 7, 1999 by the City Council.
D. That the proposed Zone Change 99-002 is consistent with the
~? policies of the General Plan, in that:
1) Policy 7.4 encourages the maintenance, marketing and further
--- ~9 development of the Tustin Market Place and Tustin Auto Center
:0 as regional retail destinations.
:~ 2) Policy 3.2 encourages locating major commercial uses in areas
that are easily accessible to major transportation facilities.

:3 E. A Negative Declaration has been adopted for this project by the City
Council in accordance with the provisions of the Califomia
24 Environmental Quality Act (CEQA).

Ii. The applicant (MacPherson properties) shall hold harmless and defend the
:6 City of Tustin from all claims and liabilities adsing out of a challenge of the
City's approval of this projectL

2s III. 'The .City Council hereby approves. Zone Change 99-002, amending the
East Tustin Auto Center Planned Community Regulations to conditionally
29 allow ancillary banquet facilities within the Tustin Auto Center, as identified
on Exhibit A attached hereto.

~ IV. If any section, such section, sentence, clause, phrase or portion of this
.~ ordinance is for any reason held out to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect
3 the validity of the remaining portions of this ordinance. The City Council of
4 the City of Tustin hereby declares that it would have adopted this ordinance
. and each section, subsection, clause, phrase or portion thereof irrespective
s of the fact that any one or more sections, subsections, sentences, clauses,
6 phrases, or portions be declared invalid or unconstitutional.
PASSED .AND ADOPTED by the City Council of the City of Tustin, at a regular
meeting on the 21st day of June, 1999.
