HomeMy WebLinkAboutORD 1171 (1996) ] ORDINANCE NO. 1171 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY 3 OF TUSTIN, CALIFORNIA, ADDING SECTION 1626b(2) (c)3 TO THE TUSTIN CITY CODE TO 4 AUTHORIZE THE CHIEF OF POLICE TO DONATE UNCLAIMED BICYCLES AND TOYS TO GOVERNMENTAL 5 AND PRIVATE NON-PROFIT ORGANIZATIONS FOR THE PREVENTION OF JUVENILE DELINQUENCY 6 7 The City Council of the City of Tustin hereby ordains as follows: Section 1. This ordinance is enacted under the authority 9 of Government Code Section 37350, which enables the City to dispose of personal property in the possession of the City for the common 10 benefit. 11 Section 2. Part 2 of Chapter 6 of Article 1 of the Tustin City Code is hereby amended by adding Section 1626b(2)(c)3 to read 12 as follows: ]3 3. Where the~property is a bicycle or toy in the possession of the Police Department, the property may, at the discretion of the 14 Chief of Police,' be given to the Welfare Department of the County, or to any charitable or non-profit organization authorized under 15 its Articles of Incorporation to participate in a program or activity designed to prevent juvenile delinquency and which is ]6 exempt from income taxation under federal or state law, for use in any program or activity designed to prevent juvenile delinquency. 17 Section 3. If any section, subsection, sentence, clause, is phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of 19 competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance.
