Dear Mr. and Mrs. Thompson: Thank you for your application for Design Review Certificate of Appropriateness requesting authorization to construct a raised rear porch and garage arbor at your residence located at 415 West 6th Street. After review of your submittal, and in conformance with Government Code Section 65943, the Community Development Department is pleased to inform you that your project has been approved based upon the findings and subject to the conditions contained in the attached Exhibit A. This action and those conditions, except as identified with an asterisk (*), may be appealed to the Planning Commission by any person provided that a petition indicating why the action or conditions are being appealed and an appeal fee, established by the City Council, are submitted. The Community Development Department action and conditions will become final unless an appeal petition and fee, as noted above, is received by the Department within seven (7) calendar days from the date of this letter. In accordance with Ordinance No. 1001 which was adopted June 20, 1988 by the Tustin City Council, the Community Development Director has the authority to approve, approve with conditions or deny Certification of Appropriateness for improvements requiring a City building permit for property located within a Cultural Resource District. The following findings are required before a Certificate of Appropriateness is issued: a. The proposed work conforms to the Municipal Code and design standards which may be established from time to time by the Cultural Resources Committee. The proposed work does not adversely affect the character of the District or Designated Cultural Resources within the District. C. The proposed work is harmonious with existing surroundings. The extent of harmony shall be evaluated in terms of appropriateness of materials, scale, size, height, placement and use of a new building or structure in relationship to existing buildings and structures and the surrounding setting. The Community Development Director has reviewed the proposal to construct a raised rear porch and garage arbor at the above mentioned address and has determined that the proposed work is in conformance with the above requirements. The proposed work has been approved based upon the above findings and subject to the conditions contained in the attached Exhibit A. The Community Development Department finds and determines as follows: A. That a proper application was filed by Mr. and Mrs. Jeff Thompson requesting to authorize the installation of a raised rear porch and garage arbor at the existing residence located at 415 West 6th Street, Tustin, California. B. That pursuant to Section 9272(c) of the Tustin City Code, the Community Development Department finds that the location, size, architectural features and general appearance of the proposal will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Community Development Department has considered at least the following items: 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Type and pitch of roofs. 5. Size and spacing of windows, doors and other openings. 6. Towers, chimneys, roof structures, flagpoles, radio and television antennae. 7. Landscaping, parking area design and traffic circulation. 8. Location, height and standards of exterior illumination. 9. Location and appearance of equipment located outside of an enclosed structure. 10. Location and method of refuse storage. 11. Physical relationship of proposed structures to existing structures in the neighborhood. .Exhibit A - Conditions of Approval Design Review and Certificate of Appropriateness 415 West 6th Street April 2, 1993 Page 2 12. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. 13. Off-site improvements, including bikeways. 14. Development Guidelines and criteria as adopted by the City Council. C. That this project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15302 (Class 2). II. The Community Development Department hereby conditionally approves Design Review and Certificate of Appropriateness for the installation of'a raised rear porch and garage arbor at the existing residence located at 415 West 6th Street, subject to the following conditions: GENERAL * 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped April 2, 1993 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. The Director of Community Development may also approve subsequent minor modifications' to plans during plan check if such modifications are to be consistent with provisions of the Tustin City Code. * 1.2 Design Review approval shall become null and void unless building permits are issued within eighteen (18) months of the date of this Exhibit. * 1.3 The applicant shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any permits. * 1.4 The applicant shall hold and defend the City of Tustin harmless for all claims and liabilities out of City's approval of the entitlement process for this project. Exhibit A - Conditions of Approval Design Review and Certificate of Appropriateness 415 West 6th Street April 2, 1993 Page 3 PLAN SUBMITTAL * 2.1 At building permit plan check submit: A. Construction plans and structural calculations, requirements of the Uniform Building Codes (UBC), State handicap and energy requirements shall be complied with as approved by the Building Official. All construction shall be in accordance with the 1988 UBC, applicable City Codes and the City's Security Code. ' * B. Preliminary technical detail and plans for all utility installations including cable TV, telephone, gas, water and electricity. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Building Official. SITE AND BUILDING CONDITIONS * 3.1 The color and material samples of the proposed paint colors shall be consistent with that of the existing residential structure and shall be submitted by the applicant for review by the Community Development Department at the time of building plan check. All exterior colors to be used shall be subject to review and approval of the Director of Community Development Department. All exterior treatments must be coordinated with regard to color, materials and detailing and noted on submitted construction plans and elevations. * 3.2 All mechanical and electrical fixtures and equipment shall be entirely and decoratively screened from public right-of-way view. The screen shall be considered as an element of the overall design of the project and shall blend with the architectural design of the main structure, FEES * 4.1 Prior to issuance of any building permits, payment shall be made of all applicable Building plan check and permit fees to the Community Development Department. Over the years, possibly through the various stages of restrofiting from a home, to apartments, and then to offices, the structure had some of the- exterior ornamentation removed. The ornamentation specific to this request is for replacement of the corner and roof eve ornaments. Submitted with this request are the following items: 1. Details of corner ornamentation. 2. Details of eve ornamentation. 3. Possible drawing of the house originating prior to the turn of the century showing the ornamentation. 4. Other samples of similar ornamentation from houses in the same period. 5. Actual size samples of corner ornamentation. All new ornamentation shall be attached to the house with nails or screws. Previous locations of ornamentation can be verified through close visual inspection of the house for varying depths in the existing painted surface.
