Dear Mr. Pitt: Thank you for your application for Design Review and Certificate of Appropriateness requesting authorization for the conversion of an existing duplex into a single family dwelling and associated remodeling of the structure located at 705 West Main Street and 350 Myrtle Avenue. 'After review of your submittal, and in conformance with Government Code Section 65943, the Community Development Department is pleased to inform you that your project has been approved based upon the findings and subject to the conditions contained in the attached Exhibit A. This action and those conditions, except as identified with an asterisk (*_), may be appealed to the Planning Commission by any person provided that a petition indicating why the action or conditions are being appealed and an appeal fee, established by the City Council, are submitted. The Community Development Department action and conditions will become final unless an appeal petition and fee, as noted above, is received by the Department within seven (7) calendar days from the date of this letter. I. . The Community Development Department finds and determines as follows: A. That a proper application was filed by Mr.Warren C. Pitt on behalf of Mr. and .Yrs. Greg Jenkins to authorize the conversion of an existing duplex into a single family dwelling and associated remodeling of the structure located at 705 West Main Street and 350 Myrtle Avenue, Tustin, California. B. That pursuant to Section 9272(c) of the Tustin City Code, the Community Development Department finds that the location, size, architectural features and general appearance of the proposal will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Community Development Department has considered at least the following items: 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Type and pitch of roofs. 5. Size and spacing of windows, doors and other openings. 6. Towers, chimneys, roof structures, flagpoles, radio and television antennae. 7. Landscaping, parking area design and traffic circulation. 8. Location, height and standards of exterior illumination. 9. Location and appearance of equipment located outside of an enclosed structure. 10. Location and method of refuse storage. 11. Physical relationship of proposed structures to existing structures in the neighborhood. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. 13. Cuff -site improvements, including bikeways. 14. Development Guidelines and criteria as adopted by the City Council. C. In accordance with Ordinance No. 1001 which was adopted June 20, 1988 by the Tustin City Council, the Community Development Director has the authority to approve, approve with conditions or deny Certification of Appropriateness for improvements requiring a City building permit for property located within a Cultural Resource District. In considering such a Certificate of Appropriateness the Community Development Department has considered the following items: a. The proposed work conforms to the Municipal Code and design standards which may be established from time to time by the Cultural Resources Committee. b. The proposed work does not adversely affect the character of the District or Designated Cultural Resources within the District. C. The proposed work is harmonious with existing surroundings. The extent of harmony shall be -evaluated in terms of appropriateness of materials, scale, size, height, placement and use of a new building or structure in relationship to existing buildings and structures and the surrounding setting. D. That this project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15303 (Class 3). II. The Community Development Department hereby conditionally approves Design Review 93-017 for the conversion of an existing duplex into a single family dwelling and associated remodeling of the structure located at 705 West Main Street and 350 Myrtle Avenue, subject to the following conditions: Exhibit A Design Review 93-017 and Certificate of Appropriateness 705 West Main and 350 Myrtle Avenue. August 4, 1993 Page 3 GENERAL * 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped August 4, 1993 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. The Director of Community Development may also approve subsequent minor modifications to plans during plan check if such modifications are to be consistent with provisions of the Tustin City Code. * 1.2 Design Review approval shall become null and void unless building permits are issued within eighteen (18) months of the date of this Exhibit. * 1.3 The applicant shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any permits. * 1.4 The applicant shall hold and defend the City of Tustin harmless for all claims and liabilities out of City's approval of the entitlement process for this project. 1.5 Pursuant to Section 9273, Nonconforming Structures and Uses of the Tustin City Code, the existing structure and the use of this property as a multiple family duplex is considered to be nonconforming with regard to structure and use. As stated in the Code, "If any use is wholly discontinued for any reason...., it shall be conclusively presumed that such use has been abandoned..-.., and all future uses shall comply with the regulations of the particular district in which the land or building is located." With the conversion of the existing duplex to a single family residence, it shall be presumed the existing use of a multiple family duplex_ is abandoned. Anv future proposals to establish accessory structures, guest room, or second unit would need to comply with applicable provisions of the City of Tustin Code. PLAN SUBMITTAL 2.1 At building permit plan check submit: * A. Three (3) sets of construction plans and two (2) sets of structural calculations, requirements of the Uniform Building Code (UBC), State handicap and Exhibit A Design Review 93-017 and Certificate of Appropriateness 705 West Main and 350 Myrtle Avenue August 4, 1993 Page 4 energy. requirement shall be complied with as approved by the Building Official. All construction shall be in accordance.with the 1988 UBC, applicable City Codes and the City's Security Code. * B. Preliminary technical detail and plans for all utility installation including cable TV, telephone, gas, water and electricity. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Building Official. SITE AND BUILDING CONDITIONS 3.1 The color and material samples of the proposed paint colors shall be consistent with that of the existing residential structure and shall be submitted by the applicant for review by the Community Development Department at the time of building plan check. All exterior colors to be used shall be subject to review and approval of the Director of Community Development Department. All exterior treatments must be coordinated with regard to color, materials and detailing and noted on submitted construction plans and elevations. 3.2 All mechanical and electrical fixtures and equipment shall be entirely and decoratively screened from public right-of-way view. The screen shall be considered as an element of the overall design of the project and shall blend with the architectural design of the main structure. 3.3 All locks and security hardware shall meet specifications as indicated by the City of Tustin Security Code. * 3.4—All utilities exclusively serving the site shall be installed underground pursuant to City Code Section 8402. FEES * 4.1 Prior to issuance of any building permits, payment shall be made of all applicable Building plan check and permit fees to the Community Development Department.
