A STREET REVISED JULY 1, 2002 The Community Development Department finds and determines as follows: A. The Applicant submitted plans into plan check to rehabilitate the existing approximately 1,500 square foot single family residential structure on the property located at 140 South A Street, located in the Multiple Family Residential (R-3) zoning district, In accordance with Section 9272 of the Tustin City Code, design review was conducted in conjunction with the plan check process. B. The site is developed with a non -conforming single-family residence that has been determined to be a hazardous structure by the Building Official. In accordance with Section 9273 of the Tustin City Code, the applicant submitted evidence that the rehabilitation project is valued at less than fifty (50) percent of the assessed valuation of the property and, as such, the structure may be rehabilitated. C. That pursuant to Section 9272(c) of the Tustin City Code, the Community Development Department finds that the location, size, architectural features, and general appearance of the proposal will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Community Development Department has considered at least the following items: 1. Height, bulk, and area of buildings; 2. Exterior materials and colors; 3. Type and pitch of roofs and roof structures; 4. Size and spacing of windows, doors, and other openings; 5. Physical relationship of proposed structures to existing structures in the neighborhood; Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares; and, Development guidelines and criteria as adopted by the City Council. D. That this project involves rehabilitation of an existing residential unit that has been determined to be a hazardous structure and is Categorically Exempt (Class 1) from the requirements of the California Environmental Quality Act (CEQA), pursuant to Section 15301 of the State CEQA Guidelines. EXHIBIT B JULY 1, 2002 CERTIFICATE OF APPROPRIATENESS 140 SOUTH A STREET hi accordance with Ordinance No. 1001 which was adopted June 20, 1988 by the Tustin City Council, the Community Development Director has the authority to approve, approve with conditions or deny Certificates of Appropriateness for improvements requiring a City building permit for property located within a Cultural Resource District. The proposed project includes the rehabilitation of an approximately 1,500 square foot residential unit on the property located at 140 South A Street currently developed with a "C" rated California Bungalow by the Tustin Historical Resources Survey, which has been determined to be a hazardous structure by the Building Official. The Community Development Department finds and determines as follows: A. The proposed work will conform to Tustin City Code Section 8103(m) in that the proposed work requires issuance of a building permit and site inspections and must be completed in accordance with the Stipulated Judgment dated May 15, 2002. B. The proposed work does not adversely affect the character of the District or Designated Cultural Resources within the District in that the rehabilitation will replicate the original style of the house and new elements are consistent with the California Bungalow style. As conditioned, the proposed rehabilitation work will be constructed of materials that match the existing residence as documented in the Tustin Historical Resources Survey to the greatest extent feasible. C. The proposed work is harmonious with existing surroundings in that the rehabilitation work will rectify a hazardous building and complement the style, material, and scale of the existing residence and the surrounding properties.
